I am a complex litigator with over 30 years of experience – having successfully tried jury and non-jury trials through verdict, litigated arbitrations through award and confirmation, and argued appeals, in federal and state courts. I have significance experience with creditors’ rights. Over the past several years, it has been my privilege to represent hundreds of thousands of citizens who have been harmed by defective products and who have found themselves, against their wishes, having to pursue their claims in bankruptcy, instead of in court or negotiating settlements. A highlight of my career was delivering the opening and most of the closing in the successful trial to dismiss the In re Aero Technologies LLC (3M) bankruptcy on behalf of the official committee and over 225,000 combat veterans and servicemembers. Claimants settled for a total of over $6 billion (6 times the announced value in bankruptcy) within weeks after the dismissal of the bankruptcy case. In addition to advising and serving as counsel for official committees, ad hoc committees, MDL leadership, governmental units and other claimants in connection with filed or potential mass tort bankruptcies, I long have represented secured creditors, such as banks, funds, and REITS, in enforcing and defending their rights, in bankruptcy court, federal and state court, and negotiated work-outs. When I am not representing creditors, I have an active commercial litigation practice in a variety of areas, including, in particular, litigating, and advising clients in, real estate disputes and governance and control disputes. My trial experience ranges from winning a permanent injunction at trial against FIFA to first chairing a successful trade secret jury trial to winning for defendant directors $0 in damages instead of $130 million sought in Delaware Chancery Court to numerous successful trials and evidentiary hearings in bankruptcy court.
