Alex Patchen has extensive experience representing clients ranging from entrepreneurs and small businesses to Fortune 500 companies in complex commercial litigation and arbitration matters. He represents clients in all phases of complex commercial litigations in federal and state courts, as well as arbitral proceedings. Mr. Patchen counsels clients in a wide range of industries including: software, financial, pharmaceutical, media, and consumer manufacturers. He also counsels on a diverse array of disputes, such as breach of contract, licensing disputes, bankruptcy and employment discrimination. Mr. Patchen’s litigation experience also covers intellectual property disputes. He has represented clients to enforce patent rights, and owners of TV programs in enforcing their copyrights and trademarks against pirates; he has obtained a permanent injunction on behalf of two tech companies for misappropriation of their trade secrets; and he has successfully defended a licensor from a patent licensee seeking millions in royalties.Mr. Patchen believes the best way to fully represent a client is to obtain a deep understanding of the client’s business, and how a specific dispute impacts the business as a whole. • Represented software development company before U.S. District Court, Southern District of New York, in copyright infringement and trade secret misappropriation action against former employees and business partner. Successfully obtained preliminary and subsequent permanent injunction for client. • Obtained a permanent injunction for software company before the U.S. District Court, District of New Jersey, in an eight day bench trial for claims of trade secret misappropriation, decision available at 2011 WL 3651331 (Aug. 18, 2011). Responsibilities included: trial preparation of fact and expert witnesses; development of arguments to successfully defeat pending motions in limine; development of strategies for both direct and cross-examination of witnesses; drafting of proposed findings of fact and conclusions of law; and provided substantive response to legal questions raised by the Judge on an issue of first impression. • Acted on behalf of bankrupt entity for the largest broker-dealer bankruptcy in U.S. history in negotiations with major international banks to resolve disputes relating to close-out of financial transactions valued at over $800 million and general creditor claims seeking over $400 million.• Presented risk analysis to New York City Comptroller’s Office to obtain settlement authority in defending the City in a high-value litigation.• Analyzed financial records, corporate documents and collaborated with financial consultants.• Served as arbitrator in Part 137 attorney-client fee dispute hearings through the New York Joint Committee on Fee Disputes.• Analyzed financial records and corporate documents for broker-dealer bankruptcy; drafted memoranda detailing the legal implications of its operational difficulties.• Represented multinational bank against third-party subpoena seeking records from the bank’s foreign branches.• Advised clients in connection with Argentina’s default of its sovereign debt.

• Collaborated with co-counsel and medical experts in development of a legal strategy for an eight-day arbitration involving medical device patent licensing. Execution of strategy resulted in dismissal of opposing party’s demand for over $100 million in royalties. Responsibilities included: trial preparation of fact and expert witnesses, defending depositions of client’s engineers, drafting fact and legal sections of the opening and closing briefs, development of cross-examination strategies, and preparation and revision of expert reports.• As second-chair of $60 million construction mediation, identified discrepancies in financial records that eliminated liability for client. • Coordinated and managed responses to 15 distinct nationwide drug-pricing actions brought by state attorneys general.• Interviewed medical device client’s employees and analyzed its records to gain a detailed understanding of its business practices to direct its legal defense. Organized, trained and led team in review of over one million of client’s business records. • Prepared demonstrative aids to explain client’s development difficulties to arbitration panel in a straightforward manner.

• Successfully represented client in a complex, international arbitration involving the development/licensing of a home goods product. Devised novel argument resulting in finding of no liability for client and instead obtained a $5 million verdict for the client. Drafted legal papers to confirm arbitration award that was confirmed by the U.S. District Court, Southern District of New York, decision available at 2004 WL 2781725 (Dec. 18, 2004).• Successfully directed investigation on behalf of a client’s effort to enforce an arbitration award. Uncovered corporation’s assets through full day deposition of corporation’s CFO and analysis of its financial records. Developed strategy and supervised its implementation, resulting in seizure of over $4 million in corporate assets, including the corporation’s aircraft and its interest in its U.S. subsidiary. • Advised client on the impact of state and federal privacy regulations to its existing data security practices.

• Assisted the Judge in all aspect of trial, pre-trial settlement conferences and the analysis of motions and arguments.

• Supervised three staff members in the maintenance of over 250 computers while a full-time undergraduate student.
