CurrentMy practice focuses on a range of environmental and administrative law issues critical to the utility, manufacturing and real estate industries, with a focus on chemical management, risk assessment, site remediation, and solid and hazardous waste management and disposal. This work includes participation in major federal rulemakings as well as compliance counseling under the nation's environmental and chemical statutes, including:- the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA/Superfund),- the Toxic Substances Control Act (TSCA), - the Chemical Facility Anti-Terrorism Standards (CFATS) Program, and- the Resource Conservation and Recovery Act (RCRA).I also advise manufacturing and retail clients on labeling and warning requirements of potential applicability to consumer products, including under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) and California's Proposition 65 (Prop 65).I counsel developers and lenders in matters associated with the acquisition, sale, and financing of industrial, commercial, and residential properties, including Brownfields. As part of this work, I help clients develop strategies to limit liability exposure and to allocate risk associated with environmental contamination and remediation, including the procurement of environmental insurance.
