At Stern Law I gained experience in the area of trusts, medical negligence, wills and estates, litigation and conveyancing.Trusts • Introducing to the Firm new clients who gave instructions to set up two separate discretionary trusts which were successfully completed by me to their satisfaction. • Procedures and law underlying trusts were researched and in the course of this matter the precedent was downloaded from LEAP and was adapted to the needs of the clients. Ancillary work was to comply with the requirements of Revenue NSW. Medical Negligence • Took a proof of the evidence of a prospective Plaintiff going into great detail and, in the process, establishing a good rapport with her. The proof was very constructive since she remains a client of the Firm and the case is proceeding in the District Court of NSW. Family Provision Litigation • Assisting in Supreme Court of New South Wales proceedings in researching the case law dealing with similar fact situations and this material was useful when a brief was prepared for Counsel. This case will go to trial in 2022. The case involved a dispute regarding whether a testator had made sufficient provision for a member of the family who had physical disabilities. Other Litigation• A case where there was a dispute between shareholders in a family company which owned valuable real estate. The client had been a director and a shareholder and it was alleged that he abused his position. • Gathering of evidence.• Preparation for trial including the collation and organisation of the materials for hearing which took place in the Equity Division of the Supreme Court of NSW. Key Achievement • Being part of the team effort that brought an excellent result to the client in the case of: Hillsea Pty Ltd v Joseph; McIvor v Joseph [2020] NSWCA 55 (30 March 2020). -
