In a very regulated market like Italy, the MKTG & TM Counsel & AIT Manager plays a key role in providing legal advice and analysis to the organisation at an early and critical stage to enable the formulation of the short and long-term strategies and policies of the organisation.Principal function is to ensure that the Company is empowered to continue to carry out lawful activity given the strict local legislation, protect the trademarks rights and manage, in proactive manner, the Anti Illicit Trade issues.In this regards the role is a first report of Top Team Member (General Counsel) and he must possess not only a specialised knowledge of a number of different areas of law but also an appreciation of the broad commercial issues affecting the business. The main areas of responsibility are the followings:Marketing:Shape Marketing strategy from a Legal perspective, developing marketing projects and providing practical solutions. Provide reasoned and timely advice on legal marketing strategies, so that the relevant marketing management can determine the optimal course of action with the relevant risk benefit balance in mind. Manage the relationship with the appropriate work streams of the Region taking part of international project boards and assuring the local implementation of specific projects in full compliance with Italian law. Manage the use of external lawyers and to provide creative solutions to Marketing. MKTG & TM Counsel and AIT Manager must be able to respond rapidly to the constantly changing legal and business environment.Trademarks: Manage IP strategy at local level, developing and implementing BAT Italia’s strategies in order to assure the right protection on all local trademarks Anti Illicit Trade:Proactive management of AIT in order to reduce the negative impact of illicit trade in Italy. Responsible for the planning and development of the AIT End Market strategy: working closely the deputed Institutions and relevant stakeholders.

Managed complex litigation and pre-litigation issues, including coordination of litigation strategy, provision of legal advice, attendance at court hearings and management of external law firms. Gained substantial knowledge and experience in regulatory framework applicable to State owned entities, including issuance of licences and permits, compensation for damages for tort or breach of contract and labour law.

Litigation Counsel is direct responsible for the management of pre-litigation, Labour, Civil, Criminal and administrative cases ("The Cases") of the company, adequately defending The Cases by ensuring the best solutions are applied.Furthermore Litigation Counsel is responsible for the management of the external law firms involved in The Cases.
