As part of Downer’s Engineering and Construction leadership team, I was responsible for the complete project lifecycle for all projects in the Division. In addition to managing a team of 35, I facilitated a 67% growth in the Renewables and Power Systems Division, which had a further forecast growth of 40% by 2021. My responsibilities included:• Identifying and managing key clients and projects.• Negotiating all major projects ($100M+) in the Division with clients and their third-party financiers, including multinational transactions.• Dispute resolution strategy, management and advice on all major disputes, including project management of the Murra Warra Wind Farm to conclusion after the insolvency of Downer’s OEM partner Senvion in 2019.• Reducing the project whole-of-life cost (CAPEX and OPEX) and increasing yields by reengineering projects and managing external stakeholders.• Project key strategic advice and claims management, with responsibility for over 40+ projects in delivery.• Advising Downer’s Executives and Board on project risk and financial viability, as well as developing the project R&O register and mark-up.• Head of procurement and implementation of Downer’s key supplier panel arrangements and procurement strategies, as well as leading Downer’s ‘Centre of Excellence’ for steel fabrication.• Chairing the monthly project management reviews and assessing project fiscal performance (against forecast), project delivery (against program), commercial issues and any erosion/upside of project margin.• Managing and developing project programs and delivery strategy, including logistics and tariff classifications.• Identifying new potential lines of business and advising on the strategic acquisition and integration of new businesses.

I was responsible for the commercial and legal success of Downer’s Utilities and Infrastructure Projects Divisions, including project award and performance. I advised on a vast range of engineering and construction services, including renewable energy, wastewater treatment, transport, rail, power systems (substations and overhead lines) and gas networks. My responsibilities included:• Managing a team of 6 and mentoring junior lawyers and other legal/commercial staff.• Engaging in the complete project life cycle from tender to project implementation, including presenting, advising and making recommendations at Executive and Board reviews. • Negotiating with government, blue chip and mining clients, as well as external project lenders.• Reporting on legal compliance and risk management, as well as managing litigated disputes without external representation. • Cross-jurisdictional negotiations and advising on international projects and the global delivery and management of commercial and legal services.• Attending commercial and operational reviews to help manage project success and profitability.

I managed the legal services for UGL’s International Engineering Division, Water Division and Power Systems Division, which required me to engage in cross-jurisdictional negotiations. My team of 5 and I were involved in the development of corporate governance and risk management systems across the business. I advised on, and negotiated, a number of major projects in the power generation, power systems, water treatment, defence, transport systems and communications, telecommunications, rail, transport and resource sectors, which included:• A panel agreement with Transgrid for their substation capital works program (contract value: $800M+).• A joint venture between UGL/Abigroup in the bid for the NBN role out in Tasmania, which included leading negotiations on behalf of the joint venture (contract value: $500M+).• An agreement with QR National Limited (now Aurizon) for the supply of 45 Standard Gauge C44ACi Locomotives (contract value: $225M+).• An O&M Contract with Melbourne Water for maintenance and low risk capital works (MALRC), mechanical and electrical (M&E) and civil works for their sewage transfer and treatment, water supply and drainage operations (contract value: $750M+).

As a major projects, construction and engineering lawyer, I provided advice with respect to building and construction contracts and related issues/disputes. I specialised in general building and construction litigation, including:• Preparing various court documents and documents ancillary to litigation.• Engaging in court advocacy in a variety of State and Federal jurisdictions.• Providing cost effective solutions to my clients through the application of my extensive negotiation skills.• Partaking in alternative dispute resolution.
