As a legal fellow with the Federal Communications Commission Media Bureau's Policy Division, I have worked on a number of Bureau and Commission Level dockets. Specific tasks include tracking and summarizing comments filed to Commission proceedings, drafting summaries of Commission items for publication in the Federal Register, drafting orders, and various other legal writing and research tasks.

With the Colorado Technology Association (CTA), I worked on a number of research and writing tasks. This included updating CTA's annual industry report. This report highlights a number of data points which are important to the technology and business climate in the state of Colorado. This includes how many public universities, the number of technical jobs compared with nontechnical jobs in the state, and the number of Fortune 500 companies located in the state. Research for this project included researching relevant news articles, economic statistics (particularly labor statistics), compiling information from other sector specific reports, and state and federal reports.Another project I tackled with CTA was the composition of legislative fact sheets. These fact sheets were brief 1 - 2 page summaries of legislation proposed in the Colorado General Assembly that were relevant to CTA's member companies and their business. These fact sheets were published on CTA's advocacy website, both for the general public and member companies. This project required searching for and pulling the legislative text from the General Assembly's website, as well as fiscal notes generated by the General Assembly explaining the economic impact of the bill. Additionally, the fact sheet may require some outside research on more advanced issues, blockchain and cryptocurrency for example, to establish proper context on the issue. This research would come from sources such as news articles, agency reports, or scholarly writings.Lastly, I also assisted with briefing CTA staff members on policy issues. One such brief involved the pending Supreme Court decision in South Dakota v. Wayfair. This case involves the collection of sales tax on internet purchases from corporations with no contact in the state. This brief required not only the review of the South Dakota statute and South Dakota Supreme Court opinion on the issue, but also the previous supreme court case law on point.

During the summer of 2017 and into the fall 2017 semester, I assisted Jon Sallet with research for an essay he wrote for the Colorado Technology Law Journal. The focus of the essay is modern impressions of Louis Brandeis's legacy when it comes to antitrust law. To research this essay, I accessed the online collection of Brandeis's works at the University of Louisville Law School, and reviewed several of Brandeis's speeches and writings. I also reviewed Senate testimony given by Brandeis, and several opinions he authored (both majority and dissent opinions). Additionally, I reviewed scholarly journal articles on Brandeis's legacy. During this research, I would flag sections I believed Jon would find relevant and useful, and then put citations for those sections into an outline. Once the essay was closer to completion, I assisted Jon in reviewing citations for not only substance, but format as well.

With the Open Technology Institute, I worked on two primary research and writing projects: the FCC's 2017 Net Neutrality Proceeding, and assisting UpTurn's Police Body-worn Camera Policy Scorecard.The 2017 net neutrality proceeding was a proceeding at the FCC to reclassify broadband internet service from a Title II service to a Title I service. I was responsible for researching and drafting specific sections of comments and reply comments filed by OTI to the FCC. The sections on which I worked focused on the history of net neutrality violations, and how antitrust applies. Research for this task consisted of reviewing various news articles and scholarly writings on the subject, comments submitted to the current and past FCC proceedings, previous FCC notices and orders, and relevant case law.I also assisted UpTurn, a group working at the intersection of technology and civil rights, with updating their Policy Body-Worn Camera Scorecard. This scorecard tracks multiple police departments' policies for body-worn cameras, focusing on areas such as camera use, film retention, and bio-metric data use. For this project, I was tasked with locating policies for multiple police departments. These would come from the police department's website when available, but other times from the city's site, or a local news publication. I then reviewed the policies and graded them on a number of factors based on criteria set in advance.

My first project involved the FCC's approach to reviewing spectrum waiver requests. The purpose was to identify specific requests that would make good pilot candidates for actuarial interference risk analysis. These waivers were identified using the FCC's ECFS database and were selected based on a variety of factors. My clinic partner and I then drafted a document explaining why the FCC should adopt this waiver review process, and explained why these requests would make good test candidates. This document was then submitted to each of the relevant request proceedings.Another project involved laying the ground work for a cybersecurity information sharing regime. This regime was to be based on a similar information sharing regime employed by the FAA and NASA, the Aviation Safety Reporting System (ASRS). As such, we researched the ASRS using documentation from NASA and the FAA, and researched variations of the ASRS employed in other industries. This included speaking with officials from various government agencies, such as the Department of Homeland Security, the FDA, and FCC to understand what challenges would go into creating such a reporting system for cybersecurity. This work culminated in the authoring of an essay for the upcoming edition of the Colorado Technology Law Journal.Lastly, I worked on a section of a white paper for public interest groups that addressed the FCC's pending reclassification of broadband internet service from at Title II Service to a Title I Service under the 1934 communications act. Specifically, the section I worked on addressed the privacy implications in light of Congress's use of the Congressional Review Act (CRA) to reverse rules put in place by the FCC under the Obama administration. For this project I researched the relevant case law on the CRA. Because the case law on point is limited, I also looked into secondary sources on the issue, specifically the Congressional Research Service's material on the CRA.

With this position I performed research for a number of different projects. I was responsible for reviewing, and summarizing comments submitted to the FCC for proceedings to reviewing Media Bureau rules on navigation devices (ie cable boxes) as well as rules governing content licensing agreements. The research for this project required extensive use of the FCC's electronic comment filing system (ECFS), which is a searchable database of comments, notices, and other documents filed to FCC proceedings.Additionally, with the FCC, I drafted an order on reconsideration finding that cable providers in multiple Oregon counties were subject to effective competition from other paid video services (such as satellite TV). This task review of FCC rules relevant to the issue found in the Code of Federal Regulations, and FCC orders interpreting the rules, found on the FCC's eDocs database, as well as Westlaw.Lastly, I was responsible for drafting a memo addressing a sponsored content issue of first impression: A radio station had contacted my supervisor inquiring how frequently the station would need to air sponsored content notifications if they sought to play sponsored content for an entire day. This project required researching past FCC orders and enforcement actions regarding sponsored content, as well as analogous issues (such as station identification).
