About Armando David Rodríguez Maldonado

My core skill consists in applying strategic intelligence and solutions to complex administrative law and policy questions in highly regulated industries of the economy, as well as identifying the political risk implications of such regulatory problems for business-government relations.To the end of developing such strategic thinking abilities from a global perspective, I have applied great effort in pursuing a legal and policy education –both in Mexico and the United States– at two forefront universities whose common pattern is an interdisciplinary approach.On the professional side, I have been fortunate in receiving the opportunity to serve the Mexican state in an official capacity within the federal administration, as part of the Finance Ministry's legal team that was tasked with performing key advisory duties for the design and approval of several "structural reforms" – which were passed by Congress in the past presidential administration (2013-2015).Also, I have been senior researcher and consultant for two of the cutting-edge law schools in Mexico where I have developed applied research on complex problematics relative to administrative law, regulatory design, and policy questions within different regulated industries – upstream petroleum, economic regulators, telecommunications, and national healthcare service.

    Framed a critical account of the regulatory framework governing Mexico’s upstream petroleum sector, as a result of the "Energy Reform" passed by Congress in 2013 and 2014. Despite the high expectations raised by the opening of the Mexican oil sector towards a market-friendly investment regime, my main argument is that there is set of institutional shortcomings present at the oil regulatory model in force, making the energy reform’s liberalization objective far from being complete.Academic Committee: Robert Cooter, Alison E.     - Designed great part of the Executive Bill on Productivity and Competitiveness –also known as the Special Economic Zones Act– which was submitted in 2014 and passed by Congress in 2016.- Participated in the design of the presidential amendment proposal to the Federal Budget and Fiscal Accountability Act and its Executive Regulations (2014), so as to embody Pemex and CFE new fiscal regime as result of the Energy Reform. - Collaborated in drafting the Executive Bill on the Economic Competition Act, in the context of the Reform on Antitrust and Telecommunications that was passed in 2013.- Collaborated in the drafting of the Executive’s proposal reform of the Federal Budget and Fiscal Accountability Act, in order to replace the zero-deficit rule for one of countercyclical and structural character, which was approved in 2013.- Intervened in the review of the Executive Bill to amend the Regulatory Railway Service Act in 2015.- Provided legal advice to the Minister of Finance in the design and negotiation of the Executive’s Budget Proposal Decree for the fiscal years of 2014 and 2015, before the Budget Commission of Congress’ House of Representatives. - Drafted the Executive Decrees instructing the strategic planning actions for all the departments and entities of the federal administration to perform from 2013 through 2018.- Elaborated legal memoranda on several proposals to update Mexico's bilateral agreements on international air services with other countries, from a competition law standpoint. - Issued formal legal opinions concerning the administrative interpretation of legislative bills and regulatory instruments, in light of their potential fiscal impact on government coffers.- Represented the Ministry of Finance in meetings summoned by the Ministry of Economy and business associations with the purpose of devising policy measures to address “regulatory bottlenecks” affecting the efficient performance of specific industrial sectors.

    Drafted an academic opinion for the Federal Commission for Regulatory Reform (COFEMER) upon the current situation of Mexico's federal administrative state. The study was entitled: "Estudio de reordenación del sistema de fuentes del ordenamiento jurídico administrativo federal". Based this analysis on three structural levels: (1) the normative system that legally supports the authoritative action of the Executive and the federal administration; (2) the relevant decisions of the Mexican Supreme Court, and (3) comparative legal studies on the matter at issue. This legal research had the purpose both to understand and arrange the functional role of the regulatory agencies to which the Mexican Constitution granted a great amount of autonomy to manage and oversee strategic sectors of the national economy, in light of the 2013 reform on competition and telecommunications. These institutional changes arose different substantive questions to the Mexican system of separation of powers; particularly, to the Executive and its presidential administration. Therefore, this project was aimed to lay the foundations for a systemic amendment of the following legislative statutes: (A) the Federal Administration Organic Act, and (B) the Federal Administrative Procedure Act. This research team was also integrated by Prof. Josefina Cortés Campos; Prof. José Roldán Xopa, and Prof. Sergio López Ayllón.

    Was part of the team of legal scholars who drafted the study requested by Wood Mackenzie Consulting and Petróleos Mexicanos: “Revisión sobre la naturaleza y regulación emitida por la Comisión Nacional de Hidrocarburos y diagnóstico sobre su vinculatoriedad para PEMEX Exploración y Producción”. This consultancy project was performed in order to both identify a map of legal risks and recommend the institutional alternatives for an incremental liberalization of the oil and gas industry. Worked on the institutional design reform of the regulatory agency in charge of overseeing the oil and gas sector of the Mexican economy: the National Commission of Hydrocarbons (CNH).Legal study requested by Wood Mackenzie Consulting and Petróleos Mexicanos Exploración y Producción (Pemex – PEP).
