An Associate Solicitor in our Commercial Litigation department, Avi deals with various high-value disputes, with particular focus on acting for claimants in large scale professional negligence cases.Avi takes a hands-on approach with all aspects of a case; from first communications, up until trial and all post judgement matters. Cases:Acted successfully for a claimant doctor appealing against the General Medical Council for not accepting his degree as a Primary Medical Qualification for UK registration.Scriven v Scriven & Ors [2013] EWHC 4223 (Ch) – Acted successfully for the Claimant, defending against an adjournment application. Mr E Murray’s judgment is the leading authority on post-Jackson adjournment applications.Scriven v Scriven & Ors [2013] EWHC 4251 (Ch) – Acted successfully for the Claimant on his application for specific disclosure against the Fourth Defendant accountancy firm. In his judgment, Mr E Murray sets out and applies the relevant principles on the solicitor’s heavy burden of ensuring that his client gives proper disclosure.Obtained a favourable settlement for the former owners of a substantial IFA business sold to a multinational group, following a series of misrepresentations about consideration, the clients having effectively lost their entire valuable business for nil consideration.Helden v Strathmore [2011] EWCA Civ 542 – Acted successfully for an unauthorised mortgage lender, obtaining possession of a substantial flat; dealing with the appeal on costs, the mortgage instrument construction and the regulatory position of a lender seeking indulgence of the Court under Section 28 FSMA 2000. Obtained a favourable settlement in a claim against a solicitor’s firm and barrister in respect of the negligent conduct of failed complex company/chancery litigation; Acted successfully in a counterclaim for misrepresentation in an action for forfeiture of a substantial Penthouse, resulting in rescission of the lease and substantial damages.
