I defend consumer product manufacturers, particularly in the personal care industry, when they are sued because of advertising claims, marketing practices, quality issues, or product defects, particularly in the context of recalls. Because it is always preferable to prepare to defend litigation before it occurs, I also counsel companies on risk mitigation strategies related to an array of regulatory issues, including compliance with the requirements of FDA, FTC, CPSC, and state laws related to e-commerce, marketing practices through various technologies, CBD regulations, VOC emissions, Prop 65, import/export concerns, and new ingredient restrictions and packaging requirements related to health and environmental goals. As consumer data is increasingly regulated, I also assist companies with developing and implementing privacy compliance regimes, working with internal legal, IT, marketing, and HR teams to comply with the CCPA and other omnibus state privacy laws and best practices for data security.
