About Bernard Morrow

I am a Toronto lawyer practicing exclusively as an alternative dispute resolution (ADR) professional. Practicing as a litigator in the early 1990s, I was initially drawn to the ADR field by a desire to achieve more efficient client-centred resolutions to disputes. This led me to take considerable training in mediation and ADR consulting, making me a more complete advocate and awakening a passion for the field of conflict resolution. Since 1994, I have been developing and refining my skills and credentials as an ADR professional. Through my firm, Morrow Mediation, I offer mediation, arbitration, appraisal umpiring, coaching, training and dispute resolution consulting services. I prefer to deliver my services in person. However, in appropriate circumstances, I offer services online via various virtual platforms. Please get in touch to find out more.In 2013, I was awarded the Chartered Mediator (C. Med) designation by the ADR Institute of Canada in recognition of my experience, training and expertise as a mediator. My areas of practice include the following:• mediation of employment, commercial, construction, partnership and insurance (personal injury and disability) disputes• arbitration of commercial and employment disputes• umpire appraisal hearings conducted under section 128 of the Insurance Act (disputes between insureds and insurers over property damage claims under Statutory Condition #11 of Ontario property insurance policies)• coaching and training for lawyers and paralegals intent on providing the best in client service• teaching/training focused on ADR processes and communication and negotiation skills• designing and delivering custom training, strategic planning and team building programs I served two terms as Complaints Resolution Commissioner for the Law Society of Ontario between April 1, 2014 and March 31, 2018, performing an ombuds role, independently reviewing complaints against lawyers and paralegals that had been closed by the Law Society. On July 30, 2020 I was appointed as a Part-Time Vice-Chair with the Workplace Safety and Insurance Appeals Tribunal (WSIAT). I adjudicate complex medical-legal disputes initiated by workers or employers regarding final decisions of the Workplace Safety and Insurance Board (WSIB) over entitlement to benefits, health care and vocational rehabilitation under the Workplace Safety and Insurance Act, 1997 and predecessor legislation.I am a past Chair of the Ontario Bar Association’s (OBA) ADR Section Executive and currently serve on the Executive as a Member-at-Large.

    The Osgoode Mediation Clinic (OMC) is an intensive clinical program open by application to 2nd and 3rd year law students. Students receive in-depth mediation training in the Fall term and then apply that training in year-long clinical placements. In the Winter term, the focus turns to mediation advocacy. Students participate in role plays and exercises and are required to submit an independent research paper at the end of the year on a topic of their choice that explores the theory and practice of mediation. Dispute resolution is finally being given the profile it deserves in law school curricula across Canada and throughout the world, and for good reason. A recent study published in the State of the Legal Market report published by Thomson Reuters Australia indicates that dispute resolution matters take up 22% of a lawyer’s time, highlighting the rising interest for knowledge and training in the field of ADR.     The Complaints Resolution Commissioner plays a vital role in the Law Society of Ontario's complaints resolution process, one similar to an ombudsman.
