With the tenacity and strategic thinking to handle “bet-the-company” type cases, he aggressively pursues his clients’ interests, focusing on results, first-class service, and value.Brian also helps clients address issues involving financial distress and represents debtors, creditors, receivers, creditors' committees, unsecured creditors, boards of directors, as well as the purchasers of financially-distressed companies both in and outside of bankruptcy. He has played an important role in many of Nebraska's largest chapter 11 cases, including Gordmans, Shopko, TierOne, Professional Veterinary Products, SportsStuff, First Americans, and QA3, and also has represented parties in some of the largest cases in the country, including Sears Corp., iHeart Media, SunEdison, Windstream, Peabody Energy, Arch Coal, Abengoa Bioenergy, Caesars Entertainment, Alpha Natural Resources, Patriot Coal Corporation, Energy Future Holdings, Petters Company, Mag Pellet, AFA Foods, and VeraSun. In recognition of his commercial bankruptcy work, the American Bankruptcy Institute selected Brian as one of its emerging leaders and honored him with its 40 under 40 award in 2018. Brian has been recognized as a “Rising Star” and a “Super Lawyer” by Thomson Reuters and in The Best Lawyers in America for commercial litigation and litigation - bankruptcy and as a Band 1 Attorney by Chambers and Partners for his Bankruptcy/Restructuring work. Brian currently serves as a member of Koley Jensen’s Executive Committee and Chair of the Bankruptcy and Creditors’ Rights Practice. He formerly served as the Vice Chair of the Litigation Department and chair of the Associate Committee that oversaw the growing firm's associate attorneys and paralegals. He also is a past member of the firm's Finance and Strategy Committees and a graduate of Leadership Omaha. Prior to joining Koley Jessen, he served as a judicial law clerk to the Honorable John F. Wright with the Nebraska Supreme Court and was Editor-in-Chief of the Creighton Law Review.
