About Brian Lustbader
I bring unique perspectives to my practice of construction law – business, technical and legal perspectives. My experience combines the technical and practical knowledge gained from a civil engineering degree and years spent managing my family’s contracting business with highly-focused legal acumen. While I primarily represent owners and developers, I also represent many contractors, architects, and engineers. I have a solid track record in resolving construction disputes resolution through mediation, but am a vigorous and thorough advocate whenever it is necessary to litigate or arbitrate. As co-chair of the New York State Bar Association Real Estate Section’s Construction Law Committee, I have overseen preparation of owner-oriented riders to the AIA A107 Contractor and AIA B104 Architect Agreement forms. I am a frequent contributor to the New York Law Journal and other industry publications and often lead seminars and lecture on topics such as construction contract drafting, performance and payment bonds, construction insurance issues, and the burgeoning field of gaining access to neighboring properties for protection during construction.
