About Brian Weinthal
I currently serve as the Chief Administrative Law Judge of the Illinois Human Rights Commission. Established under Article 8 of the Illinois Human Rights Act, 775 ILCS 5/8-101 et seq., the Illinois Human Rights Commission operates as a neutral forum for resolving allegations of discrimination and harassment that are asserted against individuals and businesses located in the State of Illinois. As the Chief Administrative Law Judge, I act as the principal fact-finder and decision-maker in cases of purported civil rights violations occurring in the areas of employment, education, public accommodation, access to credit, and transactional real estate. My work requires me to manage a sizable docket of pending actions from discovery through trial. I am also called upon to rule on motions to dismiss and motions for summary judgment, both of which are available to the litigants who appear before the Commission. In any evidentiary hearing or testimonial proceeding, the Illinois Rules of Evidence apply, which means I must address objections and determine what evidence will be accepted for consideration in any opinion or decision that I ultimately render.In addition to these responsibilities, I also supervise the other administrative law judges who work for the Commission, and I assign cases to them as new complaints are referred to us by the Illinois Department of Human Rights. My team and I are responsible for hundreds of pending disputes at any given point in time, and we take great pride in ensuring that litigants receive the same expedient, high-quality access to justice that parties would receive if they chose to pursue their grievances through the Illinois court system.
