Brigen is a member of Groom’s Executive Committee and chairs its Policy and Legislative Practice. He counsels employers, plan administrators, financial institutions, insurers, trade associations, and coalitions on employee benefits/ERISA, retirement, health and welfare, tax, executive compensation, regulatory, and legislative matters. He helps clients solve their problems and obtain favorable outcomes through legislation before Congress and regulatory guidance from the federal agencies (e.g., DOL, Treasury, IRS, PBGC, and HHS). In doing so, he draws on his experiences as Tax Counsel for the House Committee on Ways and Means, where he advised members on tax, retirement, health, insurance, tax-exempt, jurisdictional, and budget reconciliation/Byrd Rule issues.He counsels clients on all aspects of tax-qualified and individual retirement plans, including plan design and administration, tax and ERISA, multiple employer plans (MEPs, ARPs, and pooled employer plans (PEPs)), and multiemployer and single-employer pension plan funding issues. He also advises on employment taxes, reporting and withholding requirements. and the taxation of fringe and welfare benefits.His practice also includes the full range of laws that affect the administration of health and welfare benefit plans, cafeteria plans, health reimbursement, health savings and flexible savings accounts, retiree medical plans, private exchanges, and health funding arrangements. He has worked extensively on health care reform compliance, reporting, product design, and public policy matters related to the Affordable Care Act and health care reform. Brigen also counsels clients regarding the design and administration of executive deferred compensation plans, equity and long-term incentive plans, change in control and severance arrangements, rabbi trusts, employment agreements, bonus plans, and compliance with IRC Sections 409A, 162(m), 3121(v), 83, 280G, and 457.In his downtime, he enjoys coaching his boys' basketball teams, golf, tennis, and skiing, and family vacations!
