Senior employment barrister with more than 25 years in high level practice both as a solicitor and as counsel in the field of employment and workplace relations law and related areas. That practice has encompassed the provision of advice to an extensive range of private and government clients, the carriage of court (mainly superior court) and tribunal proceedings as solicitor, and/or as counsel in those proceedings. The range of clients has included:• substantial private sector employer clients in the mining and resources, building and construction, transport, education, communication and manufacturing/production industry sectors; • government regulatory agencies in civil penalty and injunction proceedings in the Federal Court and the Supreme Court of Victoria, and for the Fair Work Ombudsman in Federal Court penalty and underpayment recovery proceedings).• a number of Commonwealth and Victorian state public sector bodies and agencies including emergency services agencies. • natural person clients from a wide variety of professional and non-professional occupations, in Federal Court and Federal Circuit Court proceedings, and in proceedings in other courts and tribunals, including on a pro-bono basis.Possess a wide and deep knowledge of:• the substantive law relating to employment and workplace relations matters including enterprise bargaining and enterprise agreements, industrial disputes and dispute settlement, employment entitlements, General Protections, unfair and wrongful dismissal, anti-discrimination law, employment contracts including remuneration/bonus/incentive arrangements, restraint of trade and confidential information;• the conduct of court based litigation generally including, particularly, in the Federal Court and the Federal Circuit Court, and practice and procedure in those jurisdictions and other jurisdictions, and the development of related strategy;• the conduct of matters in the Fair Work Commission;• the law and practice relating to evidence including expert evidence and the law relating to the various privileges (including penalty privilege);• the conduct of workplace investigations.Has a substantial body of experience in mediation and conciliation, and practised in the processes and techniques of mediation and conciliation.Also worked in senior management and special adviser position in Commonwealth statutory corporation responsible for provision of essential public infrastructure services.
