• Composed memoranda regarding various aspects of complex civil litigation, including discovery, pre-trial motions, appellate procedure and settlement in securities fraud class action cases, derivative cases and antitrust class action cases.Securities Class Action Litigation• Composed a motion for leave to file a motion to exclude expert testimony.• Determined whether a motion to intervene could be filed in another case against the same defendant to gain access to discovery documents from that action. Derivative Litigation• Researched the proper purpose standard for inspection demands with regards to potential lawsuits.• Determined whether the reasonable basis standard would be applicable as a standard of knowledge for a violation of the duty of loyalty in a case regarding “robo-signing”. • Researched issues related to director independence in order to argue demand futility.Antitrust Class Action Litigation• Compiled information related to the relevant time period for discovery in order to counter the narrow window of discovery that was offered by the defendants.• Attended several “meet and confer” calls and composed the related confirmation letter to opposing counsel regarding the issues that were discussed.• Worked on the largest antitrust settlement in US history, which settled for $7.2 billion.
