Charles C. Rush advises organizations on risk management and import compliance issues with the US Customs and Border Protection (CBP), including prior disclosures, reconciliation, duty drawback, Foreign Trade Zones and other valuation issues. Charles represents clients regarding national security issues and export control matters with US federal agencies such as the Department of Commerce, Department of Defense and the Department of the Treasury. Charles's experience also includes participating in site assessments and conducting county of origin and US Harmonized Tariff Schedule classification analyses. He is a member of the Morgan Lewis CFIUS working group. Charles is admitted in Pennsylvania only, and his practice is supervised by DC Bar members.

Interviewed members of company's sales, supply chain, finance, engineering and human resources departments to learn about its trade compliance program. o Drafted two related party pricing analysis reports where intercompany transactions were assessed to determine if the company's transactions comply with CBP's arm's length requirements. o Assisted in Country of Origin (COO) analysis to assess if company’s products qualify for preferential duty treatment programs such as NAFTA and whether they are subjected to Section 301 tariffs.• Aided team in managing a Swiss semiconductor company's CBP audit. o Drafted prior disclosure to CBP detailing company’s underpaid duty based on its imported value. o Helped complete a customs reconciliation for company's imports. o Revised company’s trade manuals to comply with CBP's regulations. o Conducted Section 301 tariff analysis to determine tariffs' impact on company. o Assisted in training seminars for company's trade compliance staff.• Participated in U.S. Harmonized Tariff Schedule (HTS) and Export Control Classification Number (ECCN) classification projects.• Assisted M&A department in determining trade implications for potential acquisition.
