As a branch head, the Chair of the Patent Appeal Board is a member of CIPO's senior executive committee and reports to the Commissioner of Patents (CIPO's CEO). The primary mandate of the positions is managing the work of the Patent Appeal Board.The PAB's primary role is to conduct the by-right review of patent applications that have been rejected by patent examiners, and to advise the Commissioner of Patents whether the application should be allowed, amended or refused. The Board also coordinates all patent re-examinations and is responsible for administering the Canadian Access to Medicines Regime, the use of patented inventions by Government and the resolution of claims of abuse of patent rights.The Chairman of the Patent Appeal Board is also the Chair of the Patent Agents Examining Board and the Trade-mark Agents Examining Board, which administer the annual examinations to qualify new patent and trade-mark agents to represent applicants before the Office.
