About Chris O'Brien

As a Full Member of the Institute of Environmental Management and Assessment and a Chartered Environmentalist I not only have demonstrable experience in the application of all manner of environmental legislation but a commitment to the preservation and improvement of environmental standards, both professionally and personally.Having spent almost a decade in environmental management in the Steel Industry working with arguably the most complex sites in the UK in terms of emissions, I understand the environmental challenges facing the metals and minerals industry, as well as efforts to meet them. After my time in heavy industry I joined Natural Resources Wales (NRW) as a regulator specialising in climate change schemes, the EU Emissions Trading Scheme, the Carbon Reduction Commitment and the Energy Savings Opportunities Scheme. I also supported the wider Regulated Industry Team in determining applications for solvent emissions activities (SEA) and ferrous metals installations.In 2018 I joined SRK Consulting working in all elements of environment and social governance (ESG) within the mining industry. Projects included impact assessment and due diligence studies, in particular using my in-depth knowledge of UK and EU environmental and permitting law. I developed a niche in greenhouse gas and climate change assessments having attained Lead Verifier status in the international carbon accounting and reporting standard ISO 14064, aiding clients to establish not only the emissions from mine sites in the context of national and international commitments, but also the vulnerability of mining infrastructure to a changing climate. In 2022 I joined AMTE Power as Sustainability and Carbon Lead. AMTE Power is a fledgling battery manufacturer with three diversified cell products, a primary lithium ion cell, a high power lithium secondary cell and a secondary sodium ion cell. My role is to lead on all things environmental, social and governance, bringing together my expertise in permitting and Lead Auditor status in ISO 14001 to ensure the compliance of an existing SEA through robust systems deployment as well as preparing the wider business for scale-up to a MegaFactory planned for Dundee, Scotland in 2026.

    Natural Resources Wales is the Competent Authority for environmental regulation in Wales. I was part of a 2 person team whose role was principally to receive, determine, issue and regulate the European Union Emissions Trading Scheme regulationsThe regulations require operators that carry on with large industrial activities such as power stations, steelworks, chemical plants and oil refineries to have a permit to emit greenhouse gas (a Monitoring Plan). It was my responsibility to ensure applications or variations to permits were appropriate and in line with the Monitoring and Reporting Regulations, the Greenhouse Gas Regulations and the EU Emissions Trading Directive. Should an operator deviate from the regulations or a condition of their permit it was then my responsibility to initiate enforcement measures such as civil penaltiesI was also the lead officer in Wales responsible for enforcing both the Carbon Reduction Commitment Regulations and the Energy Savings and Opportunities Scheme Regulations. As part of the Regulated Industry Permitting Team I also determined applications for environmental permits, variations and transfers etc made under the Environmental Permitting Regulations (EPR) 2016 as well as implementing the Industrial Emissions Directive (IED) through permitting. I have experience in permitting the inorganic chemicals sector, ceramics, and non ferrous metals as well as extensive experience in the ferrous metals sector as both an operator and a regulator.

    The role was working for the Group Environment function of Tata Steel (which was based in Rotherham) as a field agent in Port Talbot Steelworks. My department in Group Environment was essentially an environmental improvement project function, and it was my role to provide a liaison for the Port Talbot steelworks to the wider resources accessible in the consultancy-like Group Environment function.The aim of the role was to aid the Port Talbot operation in meeting the requirements of it's Greenhouse Gas Permit and it's Environmental Permitting Regulations Permit, the latter of which was at the time subject to a review requiring updating in line with the fledgling Industrial Emissions Directive. As a project based role my responsibilities were to investigate environmental issues and problems (including factors which may prevent compliance with forthcoming regulations such as the IED), discover root cause and implement measures to improve the environmental performance of the business. Although the remit extended to land and water emissions, increased scrutiny on atmospheric emissions due to the IED my role focused on measurement and analysis of atmospheric particulate matter with a view to provide advice and technology to Port Talbot to enable abatement to the required concentrations.The role also required that I work towards the improvement of the management of data required by the Greenhouse Gas Permit at Port Talbot works. Due to staff shortages within the Port Talbot Works Environment Dept this developed into becoming responsible for internal carbon and energy reporting, and later responsible for the compilation of Tata Steel UK group-wide data for reporting under the Carbon Reduction Commitment Energy Efficiency Scheme.

    My role was part of a 2 man team responsible for ensuring the Llanwern Steelworks in Newport remained compliant with the conditions of its Environmental Permitting Regulations Permit, as well as to a lesser extent it's Greenhouse Gas permit. The EPR permit (previously PPC permit) covered emissions to air water and land on which it placed limits for various measurands in line with the Best Available Techniques Reference Notes (BREF) produced by the European Commission. My work at Llanwern focused on the improvement in quality of the effluent emitted from the site into the Severn Estuary, in particular to comply with emission limits set on suspended sediment within the water column (on which I carried out my MSc dissertation). Work in this area included the modelling (using the Environment Agency H1 Assessment Tool) of water quality and the effluent and the Estuary which justified a variation to the permit to increase emission limits.The role also included owning and managing the works Waste Management Contract; tracking key performance indicators, managing waste collection, classification and disposal via 3 contracted employees and proper implementation of a host of waste regulations including the Controlled Waste Regulations, the Hazardous Waste regulations and the Landfill Directive (as the site had a landfill and an associated PPC permit previously a waste management permit).
