For many small businesses, the selection and protection of their company trademarks, trade names, and service marks is critical to competing in the marketplace. The protection of products and markets using a variety of intellectual property tools is important to level the playing field in the market, particularly against large multi-national and big boxes. My primary role is to do long-term planning of how the patent strategy fits with the overall corporate strategy. I prepare documents for advancing patent prosecution, as well as drafting patent applications. I manage outside counsel, both domestic and foreign, to ensure our claims are the broadest possible. I evaluate our patent claims and determine whether competitive products infringe. I provide counsel regarding possible courses of action when we recognize infringement.

I do a wide variety of tasks for Tool Technologies. I have been working on various legal tasks, such as entity formation, tax planning, HR and employment law issues, trademark clearance and prosecution, and patent clearance and prosecution. I have also been doing high level problem solving, such as developing a new web site, resolving vendor issues, and developing workflow methods to assist the staff in performing profit-making tasks more efficiently.

I negotiate all development agreements and non-disclosure agreements. I advise the management regarding intellectual property law issues, employment law issues, retirement plans, and other legal issues that arise in any small business.
