My practice emphasizes eminent domain, condemnation, inverse condemnation and mediation. I primarily represent condemning authorities, and have condemned property for all manner of infrastructure. My experience also includes condemnation of utility going concerns. I am available to mediate eminent domain, property rights and and property valuation cases throughout the United States. Design assessment to avoid or minimize damages and litigation is a substantial part of my practice. I identify right of way, valuation and legal issues early in the process, when they are often easier and cheaper to address. In mediation, having practical experience in design assessment allows me to evaluate project impacts and reach appropriate and sometimes creative resolutions. In litigation I select appraisers and other experts who are both technically competent and good witnesses. I work with them to ensure that their opinions are understandable, defensible and admissible. This results in fewer disputes, less litigation, demonstrable cost savings and a more efficiently delivered project. I know the difference between a good appraisal and a bad one, and I have the trial experience to know how valuation testimony is likely to play out in court.I have presented programs on Eminent Domain and related topics for the State Bar of Arizona, the National and Arizona Eminent Domain Conferences (co-chair 2007-2009), National Business Institute, International Right of Way Association, American Council of Engineering Companies, Institute of Transportation Engineers, American Law Institute and the National Academies of Science, Engineering and Medicine. I co-chair the Arizona Condemnation Summit (2010-present). I am admitted to practice in Arizona, Nevada, and California.
