Clark S. Cheney is the Chief Administrative Law Judge at the U.S. International Trade Commission, where he presides over intellectual property-based investigations conducted under Section 337 of the Tariff Act of 1930 (19 U.S.C. §1337) and leads the Office of Administrative Law Judges. Previously he served as an administrative law judge with the Federal Energy Regulatory Commission and the Social Security Administration. A former law clerk to Judge William C. Bryson of the U.S. Court of Appeals for the Federal Circuit, Judge Cheney has worked as a patent examiner at the U.S. Patent and Trademark Office and in the private sector. During his tenure with the ITC’s Office of General Counsel, Judge Cheney provided legal advice in over thirty Section 337 investigations and regularly argued for the ITC at the Federal Circuit. Notably, Judge Cheney served as the ITC’s lead counsel Suprema, Inc. v. International Trade Commission, in which the en banc court affirmed the Commission’s authority to adjudicate allegations of inducement of patent infringement. Judge Cheney also served on detail to the Office of the U.S. Trade Representative, where he provided legal advice on intellectual property issues relating to trade agreements. He holds a Bachelor of Science in Electrical Engineering from the University of Utah, where he was a member of the Tau Beta Pi engineering honors society, and he graduated cum laude from Georgetown University Law Center.
