About Cynthia Khoo

Cynthia Khoo is a Canadian technology and human rights lawyer with over nine years of experience of legal advocacy and research specializing in technology and human rights law, digital rights, and Internet policy. She has worked with a variety of non-profit organizations and is the founder of a sole practice law firm, Tekhnos Law. Previously, Cynthia was a Senior Associate at the Center on Privacy & Technology at Georgetown Law in Washington, DC, where she led the organization's work streams on commercial data practices and their civil rights implications, particularly algorithmic discrimination, and the impact of worker surveillance on privacy and other human rights. Cynthia has co-authored two landmark reports by the Citizen Lab (Munk School of Global Affairs & Public Policy, University of Toronto), where she is a Senior Fellow: To Surveil and Predict: A Human Rights Analysis of Algorithmic Policing in Canada (2020) and Installing Fear: A Canadian Legal and Policy Analysis of Smartphone Spyware and Stalkerware Applications (2019). She was the sole author of a groundbreaking report by the Women’s Legal Education and Action Fund (LEAF), Deplatforming Misogyny: Report on Platform Liability for Technology-Facilitated Gender-Based Violence (2021). Her conference paper based on her LL.M. research—"Missing the Unintended Forest despite the Deliberately Planted Trees: Reasonable Foreseeability and Legal Recognition of Platform Algorithm-Facilitated Emergent Systemic Harm to Marginalized Communities"—received the inaugural Ian R. Kerr Robotnik Memorial Award for Best Paper by an Emerging Scholar at We Robot 2020. Cynthia has been consulted by various levels of government and regulators in Canada and the United States as a result of her work and regularly appears in print and broadcast media. She is called to the Bar of Ontario; holds a J.D. from the University of Victoria; and holds an LL.M. (Concentration in Law and Technology) from the University of Ottawa, where she worked as junior counsel at and represented the Samuelson-Glushko Canadian Internet Policy and Public Interest Clinic (CIPPIC) as an intervener in cases before the Supreme Court of Canada.

Cynthia Khoo Work Experience Details
  • The Citizen Lab
    Senior Fellow
The Citizen Lab Jun 2018 - Present
    Toronto, Canada Area
I joined the Citizen Lab as their 2018 Google Policy Fellow, and after that position ended, have remained affiliated with the Lab ever since, as a fellow and now senior fellow. From www.citizenlab.ca: "The Citizen Lab is a research laboratory based at the Munk School of Global Affairs, University of Toronto. Our research focuses on the intersection of information communications technologies, global security, and human rights. At the Citizen Lab, we believe that impartial, evidence-based, peer-reviewed research on information controls will help advocacy and policy engagement on an open and secure Internet. We conduct our research through a mixed methods approach that combines technical approaches from information security and network measurement with policy and legal analyses and field research."
  • Center On Privacy & Technology At Georgetown Law
    Senior Associate
Center On Privacy & Technology At Georgetown Law May 2021 - Mar 2024
Washington, District Of Columbia, United States
I engaged in legal advocacy, research, and writing to bring about legal and policy reform to protect the privacy and equality rights of historically marginalized groups, as impacted by the Internet and emerging technologies. My areas of focus were commercial data practices, including algorithmic discrimination, and worker privacy and labour surveillance. From the Center website (linked below): "The Center on Privacy & Technology at Georgetown Law is a think tank focused on privacy and surveillance law and policy—and the communities they affect. Privacy is not a luxury. It is a fundamental right under threat from both government and corporate surveillance, especially for historically marginalized people. Through research and advocacy, we challenge that surveillance and work towards a world where privacy protects everyone."
  • Tekhnos Law
    Founder / Principal Lawyer
    Tekhnos Law Jun 2016 - Jun 2021
    Toronto, Canada Area
I work at the intersection of law, Internet policy, and digital rights. Dedicating my legal career to this field and making an impact where Internet law and architecture meets civil liberties and human rights has resulted in my practice being uniquely cross-disciplinary. I've built a foundation of legal, policy, and advocacy experience in telecommunications, privacy, copyright, free expression, digital trade, including specific issues such as net neutrality and zero-rating, community broadband, and intermediary liability. My clients past and present have primarily been non-profit organizations advocating for digital rights and public interest communications policy, including OpenMedia Engagement Network, the Forum for Research and Policy in Communications, and the Community Media Advocacy Centre. I completed articles with the Public Interest Advocacy Centre in Ottawa, and subsequently founded my firm while retained as external counsel to the above-mentioned organizations. I thrive on variety and nuance, and bring boundless energy and drive to every file and project I commit to. Feel free to reach out here or via the contact information in my website below, and I look forward to hearing from you!
  • Women'S Legal Education And Action Fund (Leaf)
    Researcher
Women'S Legal Education And Action Fund (Leaf) Feb 2020 - May 2021
LEAF awarded me a research grant to research and write a comprehensive, multi-jurisdictional report examining whether and how the laws of Canada and several other countries would or might hold digital platform companies liable for technology-facilitated gender-based violence, abuse, and harassment (TFGBV). TFGBV is a form of widespread and daily abuse perpetrated by platforms' users against women and members of intersecting historically marginalized groups, including through coordinated online attacks, sexual harassment, violent threats, or the non-consensual distribution of intimate images (NCDII). The resulting publication, at 230 pages, provides legal and policy analysis bringing together TFGBV research and legal scholarship; intermediary liability law; constitutional and human rights law; platform regulation law, policy, and scholarship; and an explicit emphasis on integrating intersectional feminist principles and substantive equality. The report (linked below) provides 14 recommendations for legal and non-legal reform, including federal legislative action.
