Derek has over 30 years experience advising his clients on how to navigate the complex landscape of Tax law as it applies both in England and Scotland. Qualified as a Barrister, Advocate and Chartered Tax Advisor (CIOT) he has a wealth of experience in both personal and commercial tax, understanding how to save his clients time and money avoiding unwanted, expensive and sometimes very stressful disputes.His practice specialises in high end trust, succession, breach of fiduciary duty and tax (particularly Capital Gains and Inheritance Tax). Much of this work is advisory; drafting documents in relation to the tax implications for both individuals and corporate structures. Working closely with his clients to protect and relieve tax liability on substantial assets. Often it is the case, that a deed doesn’t achieve the tax result which it should and could if it were properly construed or rectified. Accountancy firms make up a large portion of Derek’s instruction, he finds collaboration on legal matters with accountants highly rewarding both personally and for the client. Providing the client the best possible service without risk of having a conflict of interest, which can so often be detrimental for all parties involved. Although his main focus is advisory work, Derek is a highly skilled litigator acting in a wide spectrum of trust/fiduciary litigation; petitions for removal/appointment of trustees, actions of account and petitions for directions.
