U.S. Postal Inspector (Retired)As a U. S. Postal Inspector for 27 years I Conducted federal criminal investigations related to the protection of the U.S. Postal Service, its employees and assets, and investigated criminal misuse of the U.S. Mail. My Primary investigative focus was on Narcotic Trafficking. Assigned to the Milwaukee HIDTA Task Force’s Drug Interdiction Unit from 2011-14. I prepared complex cases for state and federal prosecution and actively participated in all stages of preparation for trials. I assisted in preparing indictments and affidavits for arrests and searches. I conducted interviews and interrogations for court testimony. Well versed in federal case law relating to reasonable suspicion required to seize a package, lawful seizure of a package and proper time periods for warrantless detention of mail. All these factors must be considered when investigating narcotic trafficking via U.S. Mail to avoid creating bad case law that will limit future investigations. Not every investigator considers all the ramifications when seizing packages and the result may lead to stricter case law. Knowledge of the below listed federal cases secured air tight cases and asset forfeiture that could stand up in any motion hearing brought on by defense counsel. • U.S. v. Huerta, No. 10-3434, U.S. Court of Appeals for the Eighth Circuit. Reasonable suspicion to seize package• United States v. Johnson, 171 F.3d 601, 603 (8th Cir. 1999). Reasonable suspicion to detain package• United States v. Van Leeuwen, 397 U.S. 249 (1970). Detention of mail for 29 hours• U.S. v. MAYOMI•873 F.2d 1049, 1051 (7th Cir. 1989) Detention of mail up to 48 hours• United States v. Gill,. 280 F.3d 923, 928 (9th Cir. 2002). Permits reasonable investigative steps that do not intrude on privacy and do not significantly delay mail.
