Dan is a Partner in L’Abbate, Balkan, Colavita & Contini, LLP’s Melville, New York office where his practice focuses on insurance coverage and civil litigation in state and federal courts, alternative dispute resolution forums and in professional disciplinary actions. Specifically, Dan has extensive experience defending architects, engineers, construction managers, general contractors, owners and material suppliers in a wide range of multi-party complex construction claims including malpractice, breach of contract, delay, subrogation, personal injury, environmental, labor law and property damage. Dan also specializes in the representation of insurance carriers in complex insurance coverage disputes arising under various forms of comprehensive general liability, excess and umbrella policies of insurance. Further, he provides risk management consulting services and practices in the field of hospitality litigation defending hotels/restaurants in cases involving general liability and premises liability.Dan is admitted to practice before the Courts of the State of New York, the State of New Jersey, the United States District Court for the Southern District of New York, the United States District Court for the Eastern District of New York and the Supreme Court of the United States. Dan has presented construction and professional liability seminars at both regional and national conferences including the Claims and Litigation Management Alliance (CLM), American Council of Engineering Companies (ACEC) and the American Institute of Architects (AIA). He has also given lectures at the request of insurers on the subjects of mediation and civil practice litigation. In addition, Dan has authored several articles on construction topics. Dan manages the CLE program for the firm, which is a New York State accredited CLE provider. He holds the Preeminent AV® Peer Review Rating from Martindale-Hubbell®, its highest rating for ethics and legal ability. He was also selected as a Super Lawyer in the 2019, 2020, 2021 and 2022 New York Metro Edition of New York Super Lawyers.Dan graduated from the University of Scranton in 1996, earning a Bachelor of Science degree in Political Science. Thereafter, he earned his Master of Arts degree in History in 1998 from St. John’s University and subsequently earned his Juris Doctor in 2003 from St. John’s University School of Law. When Dan is not tirelessly advocating for his clients, he enjoys skiing and spending time at the beach with his wife and two daughters.
