Represented partner/personal guarantor of $385 million commercial development and related entities in defense of claims by national bank for breach of lease agreement and personal guarantee. Obtained favorable settlement for client based on strength of counterclaims and potential crossclaims. Obtained summary judgment in lease termination dispute on behalf of operator/lessee, which had withheld payment of royalties to the plaintiff/lessor based on a defect in the underlying deed. Summary judgment was granted based on the existence of a good faith dispute concerning title pursuant to both the lease provisions and Section 91.402(b) of the Texas Natural Resources Code.Obtained summary judgment in defense of fraudulent inducement and fraud by non-disclosure claims arising out of the online sale of several overriding royalty interests (ORRIs) in oil and gas wells. Represented operator/lessee in dispute in which the plaintiff challenged the validity of amendments to two pooled units and alleged underpayment of royalties. Obtained favorable settlement for client based on strength of pending summary judgment motion arguing ratification of the amended units.First-chaired bench trial on claims of first impression brought under the Texas Structured Settlement Protection Act and successfully obtained confirmation of subject transfer of annuity proceeds under the Longshore and Harbor Workers Compensation Act (LHWCA). Represented lessee in defense of tortious interference claims in which the plaintiff challenged the validity of the client/lessee's top lease. Resulted in favorable settlement for client based on strength of pending Rule 91a motion to dismiss seeking recovery of attorney's fees.Elected to firmwide Dykema Associates Committee.

Joined Texas-based Strasburger & Price LLP shortly before its merger with Clark Hill. Part of plaintiff trial team in 7-day jury trial in federal court on a multi-million dollar breach of contract and breach of fiduciary duty case. Cross-examined Vice President of Fortune 1000 defendant. Resulted in favorable settlement for client on second day of jury deliberations. Obtained expungement of wrongful lis pendens filed on real property by former partner of client and successfully defended against plaintiff's application for a temporary restraining order to prevent the sale of said property.Obtained dismissal for orthopedic surgeon and product manufacturer clients in qui tam action in federal court against claims of False Claims Act violations, unjust enrichment, and payment by mistake.Compelled arbitration of shareholder derivative suit in state court against signatories and related non-signatories to surgery center partnership and management agreements. Obtained dismissal for Housing Authority client in federal court against claims for due process violations and disability discrimination. Represented maritime corporation in arbitration before the Houston Maritime Arbitrators Association relating to defense of breach of agency contract claims and pursuit of counterclaim for breach of fiduciary duty. Resulted in favorable settlement for client.

Joined Chicago-based boutique firm specializing in commercial and insurance coverage litigation with partners from Donato, Minx, Brown & Pool, P.C. Part of trial team (second chair) that obtained complete defense verdict after week-long jury trial in premises liability/construction defect case. Cross-examined Plaintiffs' liability expert. Obtained summary judgment in federal court (2016 WL 7650619) in favor of insurer on basis that fortuity doctrine barred coverage for third-party lawsuit as matter of public policy.Obtained summary judgment in state court (Harris County) in favor of insurer on first-party property claim submitted by commercial complex, where underground sewer drain pipe collapsed and flooded buildings.Represented Fortune 500 company in pursuit of funds wrongfully submitted as business expenses by former employee. Resulted in favorable settlement for client. Second-chaired oral argument before the Texas Supreme Court regarding application of an insured versus insured exclusion in a D&O policy (512 S.W.3d 890).

Represented client on appeal of summary judgment motion regarding application of the workers' compensation bar to claims by a general contractor's employee against a subcontractor enrolled under an owner-controlled insurance policy (OCIP). Drafted briefing on the merits to and second-chaired oral argument before the Texas Supreme Court (498 S.W.3d 68). Represented Fortune 500 company in pursuing multi-million dollar breach of contract action with regard to early termination of a product supply agreement. Resulted in favorable settlement for client.
