This litigation followed after the murder of a student (Juan van Minnen) on a suburban train stretching over more than 5 years and which culminated in a judgment of the Constitutional Court of South Africa; Rail Commuters Action Group and Others v Transnet Ltd t/a Metrorail and Others 2005 (2) SA 359 (CC). • A separate summary of a whole series of litigation and reported cases is available at request. • Widely acknowledged as the driving force behind a team of lawyers obtaining relief for injured rail commuters in a landmark decision, one of the first cases of its kind, in which a structural mandamus was granted by the court of first instance (enforcing improved safety and security for rail commuters).• Enormity of the related legal work and eventual vindication is described in an article published in The Advocate, April 2005, A tribute to lawyers involved in the Metrorail case by the then Chair of the General Council of the Bar, Norman Arendse SC.
