General Counsel
- Lead and manage 65-person Legal Division and serve as legal advisor to the Commission. Also reviewed other agency and staff action such as staff no-action letters; interpretive letters; guidance; exemptive orders, and registration orders.-Regularly handled crisis management and key cases, including: -In re CFTC, 941 F.3d 869 (7th Cir. 2019): Effectively managed crisis litigation in which district court order the Chairman, two Commissioners, Director of Enforcement, and multiple agency attorneys to testify in contempt proceeding regarding alleged breach of settlement agreement. Working at the district and appellate courts, obtained rarely granted writ of mandamus from the Seventh Circuit prohibiting the questioning of agency officials for official actions. -CFTC v. Monex Credit Co., 931 F.3d 933 (9th Cir. 2019): Successfully reversed district court decision dismissing Commission's claims for metals trading fraud under Commodity Exchange Act (CEA) Section 6(c)(1) (fraud and manipulation) and Section 2(c)(2)(D) (actual delivery).-Chairman's Award for Excellence (2019): Recipient of highest individual honor in the agency, given to one employee annually in recognition of extraordinary accomplishments and superior service dedicated to realizing the vision, mission, and values of the agency.-Reviewed proposed enforcement actions and key legal theories being advanced by the Division of Enforcement. -LabCFTC: oversaw the agency's first innovation and FinTech initiative, which was originally placed in the Office of General Counsel.
