Represented assignees of various Medicare Advantage Organizations in federal class actions around the country (Florida, Maryland, Illinois, and California) seeking reimbursement under the Medicare Secondary Payer (“MSP”) Act, 42 U.S.C. § 1395y(b), against various automobile insurance companies. Drafted class action complaints, motions, oppositions to motions, requests for production, interrogatories, and other litigation documents. Also drafted appellate briefs in the United States Court of Appeals for the Eleventh Circuit.Obtained a class settlement for individuals who were wrongfully denied coverage for life-saving hepatitis C treatment.Represented third-party payers in multidistrict litigation (“MDL”) against pharmaceutical companies arising from the manufacture, sale, and distribution of contaminated blood pressure medications, valsartan, losartan, and irbesartan. Also represented third-party payers in consolidated case involving contaminated metformin-containing drugs.Represented third-party payers in an antitrust action against the manufacturers of combination anti-retroviral therapies (cART) (and their generic equivalents) used to treat HIV for anticompetitive conduct.Represented Colombian liquidator in Chapter 15 bankruptcy proceedings. Obtained several recoveries in adversary bankruptcy proceedings over real property involving assets from the judicially intervened Colombian company.
