Phd ResearcherUniversity Of East Anglia Oct 2011 - Sep 2015Norwich, United Kingdom‘Revisiting the role of the public interest in merger control'ABSTRACT: The last half-century has witnessed a drastic change in the way states choose to assess merger transactions. Whereas the consideration of wider public interest issues was once a prominent part of the merger assessment process in many domestic regimes, its role has been eroded by the emergence of economic competition-based criteria. This competition-based approach has since established an almost universal endorsement worldwide, with the huge majority of states now adopting it. But the majority of these states still reserve a role for public interest goals in their merger regimes, albeit a very restricted one in most cases.My thesis explores the modern day role of the public interest in merger control in the face of international convergence towards a competition-based approach. Using a combination of abstract legal theory, empirical analysis and comparative case studies, the thesis draws conclusions on the credibility of accommodating public interest criteria in merger control.
