David represented the interests of architects, engineers, owners, design professionals, contractors, and real estate owners and developers in complex construction and related litigation. He brought experience representing owners and contractors in statutory and premises-related claims involving work at construction sites. In addition, David has represented professionals and organizations in defense of claims alleging premises liability or professional and medical malpractice. David leverages his deep experience in appellate litigation, having briefed, argued or otherwise litigated more than thirty appeals before the appellate courts in New York. David has been entrusted to handle key litigation disputes across the litigation life-cycle, from jurisdiction, discovery, and summary judgment to post-trial legal sufficiency and excessiveness of damages.

Taught a course on legal institutions, contracts law , and negotiable instruments/commercial paper. Designed lesson plans for undergraduate students about core contract law concepts such as the formation of agreements, policing enforcement of agreements, writings, third-party rights, damages, contract performance, and the impact of UCC Article 2. Designed lesson plans for undergraduate students to appreciate laws affecting negotiable instruments/commercial paper and payment systems, including exploring foundational sections of UCC Articles 3, 4, and 4A. Established and verified the validity and statistical reliability of instruments that assess student learning.Passed on a love for the law.

Litigated as part of the construction litigation practice group. Drafted and argued appellate and substantive trial motions, including for summary judgment, reargument, and seeking appellate stays of trial. The work also involved analyzing contracts, drafting settlement agreements, evaluating liability and third-party practice, assessing risk transfer options, developing overarching legal strategies with an eye toward prudent and responsible defense, and, if needed, facilitating a mediated or managed resolution of matters. As part of the firm's specialized appellate practice group, David successfully briefed and argued numerous appeals and substantive trial-level motions. He counseled attorneys in the firm and his clients on issues of legal strategy, including trial and appellate civil procedure, the likelihood of success of filing motions and appeals. He has had unusual success in obtaining appellate stay motions that have mitigated risks of adverse liability findings and facilitated favorable settlements or the reversal of significant court orders. In addition to having deftly navigated oral arguments before trial courts, appellate courts, and mediators, David prides himself on having drafted compelling substantive motions, trial memoranda, briefs, and other forms of written advocacy.

David honed his litigation strategy, drafting, research, and analytical skills at Mauro Lilling Naparty LLP, a boutique focused exclusively on appellate advocacy and litigation strategy. With guidance and training from experienced appellate advocates, David successfully litigated complex civil appeals in the New York State appellate courts, with more than a dozen published appellate decisions crediting his work. Clients sought out MLN for its deep experience in the appellate courts, which led to a varied practice encompassing commercial litigation, employment law, construction litigation, premises liability, general negligence, medical malpractice, matrimonial, healthcare law, toxic torts, defamation, entertainment law, legal and other professional malpractice, punitive damages, insurance coverage, and insurance bad faith claims.

Legal intern during the summer and academic year at an appellate practice and litigation strategy boutique. Researched and drafted memoranda, including surveying state interpretations of an exclusionary evidence rule for a professional liability action at the New York Court of Appeals.Prepared advisory opinions about whether to appeal trial court orders based on likelihood of appellate outcomes.
