Dave formed Max Exploration, LLC in 2011 to continue the tradition of his grandfather and parents to build a portfolio of mineral and royalty interests throughout the Rocky Mountains. He continues to acquire key mineral rights, focusing on North Dakota, Wyoming, Utah, and New Mexico. He specializes in the closeout of small estates with varying interests and tricky titles.

Oil and Gas Title and Transactions: Dave routinely advises clients regarding the acquisition and ownership of oil and gas interests. He has extensive experience with federal lands, federal units, complex title issues, and regulatory guidance. Real Estate Transactions and Leasing: Dave also regularly assists his clients in the acquisition, ownership, leasing, and disposition of commercial real estate. He particularly enjoys representing both landlords and tenants in drafting and negotiating retail leases.

In June of 2019, Dave founded Max Permian, LLC, as his first leasehold venture. Working with a partner, he aggregated a strategic fee leasehold position in the Northern Delaware Basin in New Mexico. Beginning in 2021, the company participated in several new horizontal wells on these lands with first-class operators. The company successfully divested its assets in December of 2022.

Max Minerals, LLCIn 2018, Dave started his first mineral fund, targeting mineral and royalty interests in the booming Permian Basin. The company successfully divested all its assets in October of 2019. Max Minerals II, LLCIn 2020, Dave formed his second mineral fund, targeting mineral and royalty interests in the Bakken of North Dakota. Although the fund closed as a result of Covid, the company was fortunate to return 100% of capital to its investors.

At Holland & Hart LLP, Dave led the oil and gas title group in New Mexico. He used his extensive experience to render hundreds of drilling, division, order, financing, and acquisition title opinions, He regularly advised on oil and gas matters on federal, state, Indian, and private lands from the Bakken to the Permian. He also used his background in transactions and commercial real estate development to represent clients in the acquisition, ownership, leasing, financing, and disposition of commercial real estate. He drafted and negotiated hundreds of retail and office leases for both landlords and tenants.

As a law clerk, Dave worked closely with experienced attorneys in the oil and gas title group. He developed a fascination for oil and gas / real estate law and was eager to research developing issues in these fields.

As a transaction manager, Dave assisted in facilitating countless deals involving oil and gas leases and mineral interests. Dave was responsible for maintaining a land database and overseeing the land and title department.

Dave was a praised broker for the company and helped clients buy or sell over 25,000 acres of mountain and ranch property throughout the state of Utah. He worked with his clients to address various issues such as legal access, prescriptive easements, boundary disputes, water rights/shares, mineral rights, conservation easements, hunting units, and grazing leases.
