David practices in the area of complex and class action litigation, with a primary focus on antitrust and consumer protection.Professional Accomplishments:Member of the legal team that represented the Mississippi Attorney General’s Office in Mississippi ex rel. Hood v. AU Optronics, 134 S. Ct. 736 (2014), where the Court unanimously held that an attorney general’s consumer protection enforcement action is not a “mass action” under the Class Action Fairness Act. David argued the case before the U.S. Court of Appeals for the Fifth Circuit, and was on brief before the Supreme Court.Leadership steering committees, including in In re Pork Antitrust Litigation (D. Minn.), a case alleging widespread price-fixing. Dave also served as discovery team leader coordinating complex discovery in In re Generic Pharmaceuticals Pricing Antitrust Litig, 16-md-2724 (E.D. Represented hundreds of residents in In re Soo Line Railroad Company Derailment of January 18, 2002 in Minot, N.D., who were injured by the toxic spill caused by the derailment of a Canadian Pacific Railway train; drafted federal legislation passed to eliminate Federal Railway Safety Act preemption in that case.
