I help clients plan for and secure good outcomes by negotiating agreements, resolving disputes, drafting contracts, and protecting their intellectual property. I also help them navigate more troubled waters of business arrangements gone awry or of dealing with the harmful conduct by others, such as misappropriation or infringement of intellectual property. When taking a case all the way to a judge or jury is the best or only means of getting a desired result, I greatly enjoy the challenge of achieving success for clients in court. Early in my practice I learned that the majority of business disputes are solved through negotiation and not trial, however. And so, for some years I concentrated in the then-emerging fields of negotiation and mediation, serving widely as a mediator, teaching and practicing through the Duke Private Adjudication Center, and teaching negotiation and mediation at the UNC School of Law. Ultimately, however, the satisfactions of being an advocate for a client and not a neutral intermediary drew me back to a litigation and counseling practice, where in-depth engagement with the client’s needs gives me a greater sense of providing a service, as well as more intellectual satisfaction. In addition to continuing to work with a variety of issues in the business and employment contexts, in the last decade I have spent much of my time on intellectual property related client needs, such as trademark and copyright counseling and litigation, trademark prosecution, domain name disputes, patent litigation, and trade secret disputes.
