Happily Retired for a Second Time!After a long and successful career as a corporate tax executive and a rewarding tenure as the economic development director for my wife's hometown of Childress, TX (Population 5,737, a vibrant rural community in the southeast Texas panhandle), I am fully embracing my re-retirement in central Texas to be closer to family. It has been a fun ride, but I am ready to slow down and enjoy the wildflowers and resume my genealogy research. Directed teams responsible for state and local taxes in all states and the District of Columbia including all indirect taxes and the related tax jurisdiction audits for more than 700 operating locations. This included the timely and accurate preparation, review and filing of tax returns for sales and use tax, property tax rendition, appeal and payment processes, franchise tax, state and local annual business licensing, setting up the appropriate tax reserves under FAS 5, and FIN 48, response to state and local tax authorities inquiries and tax audit requests utilizing in-house personnel or outside vendors, as necessary.During the first quarter of 2009, led a team to locate and return to Cemex dormant "tax related" cash. Initiative deposited in excess of $53 million in the Cemex bank account. As part of this initiative, negotiated from the State of California a check in excess of $24 million at a time when California was issuing IOU's and not cash.An architect of a 2007 and 2009 U.S. legal entity restructuring project necessitated by the $14 Billion Rinker Materials Corp acquisition. This project reduced the state income and franchise tax by several million dollars per year while reducing the indirect tax monthly tax compliance filings by 60%. This initiative also allowed for the centralization of the sales tax, property tax and business license functions.Actively involved in multiple pre-acquisition due diligence assignments, potential asset swap negotiations, sale of excess Cemex / Rinker assets and the acquisition of the Ready Mix USA joint venture interest.Negotiated a sales tax revenue sharing program with two cities in California generating $2 million per year in cash flow.Received a Texas Enterprise Project designation from the Texas governor's office on a cement plant expansion returning over $1 million in sales tax to Cemex.Consistently reduced state and local income and indirect tax audit assessments by double digit percentages.

This U.S. restructuring eliminated a complicated system of intercompany charges, allowed for the use of an efficient transfer pricing methodology while reducing indirect tax monthly filings by 75%.Effectively represented Cemex in all federal state and local tax audits. Peers inside and outside the company have commented on my unique ability to resolve complex tax audits. An example would be an Arizona sales tax audit with a preliminary assessment in excess of $27 million that I settled for $295,000 representing a 99% reduction.
