Representative matters while at Snell & Wilmer include:- Represented bank group in successfully negotiating full-pay plan of reorganization following contested, competing confirmation hearings over three-month period in Chapter 11 bankruptcy of Arizona’s largest private homebuilder- Represented group of borrowers/guarantors in $900 million Chapter 11 bankruptcy of Arizona’s largest private commercial mortgage broker, including filing of involuntary petition, negotiating plan treatment of approximately $150 million in claims by and against borrowers, and negotiating global settlement of all claims- Represented Creditors Committee in obtaining $100 million preliminary injunction against former officers/directors of privately-owned homebuilder, then reaching global settlement of all claims following mediation- Represented DIP lender and stalking horse purchaser through court proceedings and auction, resulting in successful $80 million purchase of substantially all of the debtor’s assets in Chapter 11 proceedings before the Delaware Bankruptcy Court- Representing court-appointed receiver over historic theater located in Hollywood and eight commercial properties located in San Francisco- Representing court-appointed receivers in all facets of general equity and limited receiverships, including those involving sand and gravel company, automobile dealership, video game developer, apartment complexes, commercial real estate, golf courses, medical clinic, and residential home builder- Sought appointment of receiver over two large apartment complexes, then negotiated global settlement of $70 million of liabilities following borrower’s initiation of Chapter 11 proceedings- Represented purchaser of resort and five golf courses in the Phoenix metropolitan area in Section 363 bankruptcy sale- Represented commercial bank in obtaining contested appointment of receiver over apartment complexes owned by related entities in state and federal court
