It involves supply and demand of the physical space, the financing thereof, what is conducted within, the term or period of leases or ownership and often the operation of each business in a given catchment.A lease and the structuring thereof, goes to the heart of any business. In Australia far far too little thought goes into the preparation and STRUCTURING of leases. Straight-jacket leases, lack of security of tenure, ratchet rents are a feature in the property landscape here in Australia. Business owners (and their advisors) should carefully consider giving up their capital in any leasing situation, unless they can get a properly structured lease offering: 1. secutiry of tenure; 2. rents that can regularly be reviewed to market rent; 3. ability to amortise setup costs.If landlords structured leases better, they could mitigate potential claims for breach of quiet use and enjoyment. Better. Or avoid them altogether to do renovations/extensions, etc. Show less
