About Dr Kislay Panday

Growing up, the world of law was a familiar landscape to me. Fueled by an innate interest and my family's legacy in legal academia, I gained a deep insight into the realm of law. As I progressed in my studies and embarked on my professional journey, the intricacies and challenges of the system became increasingly apparent. Throughout my years of practising law, I frequently encountered systemic hindrances: lengthy legal processes postponed verdicts, and congested courts.Beyond the hurdles of limited judicial resources and complex legal terminology, a significant gap emerged: India's tepid embrace of alternative dispute resolution (ADR) methods. The potential of ADR to provide efficient solutions was evident, yet its adoption remained limited. This revelation, combined with my unwavering commitment to reform, led me to serve as a Solicitor at the Honourable Supreme Court of India. In this capacity, I've championed the advantages of ADR, emphasizing its swift resolution, affordability, and heightened client satisfaction. Throughout my career, I've handled a multitude of cases spanning diverse sectors, many of which were resolved through ADR.Now, as the Senior Partner and Partner in Chief at two distinguished law firms, and an active member of several international legal forums, my focus remains on improving transparency, efficiency, and integrity within the legal system. My keen eye for detail and vast hands-on experience have consistently been at the forefront of uncovering notable corporate and banking discrepancies. My expertise encompasses:-Constitutional Matters-Corporate Disputes-Debt Recovery-Bail Matters-National Company Law Tribunal-Debt Recovery Tribunal-Serious Fraud Investigation Office-Corruption and PC Act Matters-Economic Offences-Complex Matrimonial Disputes-Money Laundering (PMLA Matters)-Arbitration-Election matters-Real Estate mattersBeyond my court endeavours, I'm a published author of two books and am currently penning more, aiming to shed light on India's judicial intricacies and potential pathways to reform.

As of 2021, there were over 40 million cases pending in the Indian court system, including the Supreme Court, high courts, and lower courts. A shortage of judges, complex legal procedures and a system that’s rigged with corruption leads to delayed justice. According to official data from 2021, it takes an average of 17 years for a case to be resolved in the Indian court system, from the filing of a complaint to the final disposition of the case. And justice delayed, is justice denied. While the shortage of judges and complex legal jargon is to be partially blamed, there is another facet causing this issue. And that being the lack of alternative dispute resolution (ADR) mechanism in India. According to a survey conducted by the Ministry of Law and Justice in India, only 4% of the disputes in India are resolved through ADR mechanisms. The lack of ADR mechanisms combined with nil awareness about ADR increasingly burdens our courts.I constantly encountered certain challenges, prompting my transition to a solicitor. This shift enhanced my authority to endorse ADR mechanisms, enabling my clients to enjoy expedited dispute resolutions, reduced expenses, and heightened satisfaction.I have adeptly managed over 500 disputes spanning areas like real estate, corporate fraud, and banking fraud.

Throughout my legal tenure, I’ve successfully handled numerous cases. Securing justice is a rewarding job but concurrently I’ve also seen our society degrade. An absolute lack of values, hedonism and plain ignorance have led to a society that is increasingly self-centred and despotic. Writing books is my contribution to making this society a better place. Through my writings, I aim to educate and connect my fellow Indians back to their roots. My first book, Sovereign, is an exploratory and detailed analysis of the Indian political scenario. A clear way forward can only be forged after an honest look in our past. My book aims to do the same and then conclude with a prescriptive doctrine. After nurturing the idea for over 15 years, I suggest a constitutional body by the name of ‘People’s Commission of India’. It meant creation of a regulatory body that would keep the government accountable and be presided over by the common man of India. My second book, Abhishapt is a novel about a man losing everything he had because of his ignorance. It is inspired by true events. I am currently working on several other books that are based on my keen interest in theology.
