The new business line is now called Enel Green Power and Thermal Generation. With this change, we split the management of the legal department into "Development Legal Affairs" and "Corporate Affairs and O&M Legal Affairs". While we run the department as a single team, this change allows me to focus on the development, construction and financing of our projects and also on the financing and commercial office matters. A good change allowing a more intense focus on the biggest challenges we face.

In July 2015, I embarked on an great new challenge within Enel Green Power: leading the legal support for the company’s expansion in Sub-Saharan Africa and Asia.I am now based with my family in Rome, Italy, at an exciting time at the company.We are already in India in a joint venture with Bharat Light & Power and have 1.2 GW of wind and solar at various stages (in operation, under construction and awarded) in South Africa. We are also working on a mini-grids project in Kenya with Powerhive.The work is especially challenging, not only for the speed at which the company intends to grow (the Strategic Plan calls for 7.1 GW over the next 5 years), but also because many of the projects are in joint venture with local partners, many are expected to be project financed, and many involve novel business models (mini-grids, retail solar) and innovative technologies.I will miss the team in Latin America, where I started with Enel in 2007. Ali Shakhtur, formerly general counsel for Chile and Andean countries has taken over leadership for the Latin America region. Back in 2007, we started as 4 lawyers and over 8 years grew to a true in-house law firm of 30 lawyers. Now it’s time to re-start with four excellent lawyers (three in South Africa and one focusing on India from her base in Madrid).

Enel Green Power S.p.A. is the renewable energy subsidiary of Enel S.p.A. Since June 2007, I have worked with EGP business development and engineering in the development and construction of 1.1 GW (net installed capacity) of renewable projects in the region, with another 700 MW currently under construction, and over 1.1 GW ready to build.In this period I assisted with the expansion of operations and development of projects in Guatemala, El Salvador, Nicaragua, Costa Rica, Panama, Brazil and Chile, including hydro, wind, solar and geothermal projects; and added development and operations in new countries, including Mexico, Colombia, Ecuador, Peru, and Uruguay.I report directly to the CEO for Latin America, with functional report to the general counsel of Enel Green Power, S.p.A. in Rome.As General Counsel, I have assembled and lead a team of local in-house attorneys and outside counsel to provide legal support for development through due diligence, joint development agreements, construction contracts (EPCs, BOPs, turbine supply agreements etc.), corporate and project financing, licensing, land rights etc., and support ongoing operations of existing facilities with PPAs, financings, litigation, environmental compliance, etc.Litigation work has included, in particular, a successful ICC arbitration (and defense of counterclaims), followed by a ICSID claim relating to an important joint venture in Central America; the whole finally settled in 2014 with a favorable outcome for EGP.I also support the compliance function and manage corporate governance matters in the region; including organizing and executing the corporate ownership changes in advance of the spin-off of Enel Green Power from Enel in late 2008 (and subsequent public offering in 2010).
