I undertake a range of insurance and commercial litigation, particularly property damage disputes arising from fires, explosions, floods, and design/construction failures. I defend incoming liability claims and pursue subrogated recoveries. I also provide advice to insurers in relation to policy indemnity, especially public liability (PL) and contractors all risks (CAR) policies. My clients include insurers and their insureds, companies and private clients, in a range of different sectors, including commercial, property, construction & engineering, and transport. I regularly act for employers, main contractors and sub-contractors in construction disputes involving these parties and other construction professionals. Recent case highlights:Acting for a sub-contractor and its PL insurers following a number of escapes of water at a well-known London development. I successfully pursued a claim for indemnity under the Project Policy pursuant to the Contracts (Rights of Third Parties) Act 1999.Following a devastating fire at a Grade 1 listed property, I was instructed by the tenant's property insurers, and successfully pursued a recovery against the freeholder. I acted for a housing developer in relation to a claim arising from damage to a gas main caused by piling works. The claim was resolved pre-action at a multi-party mediation. Acting for an ME sub-contractor following a very significant escape of water in the basement of a mixed use development undergoing construction. Acting for insurers in arbitration proceedings. Insurers declined a claim brought by their insured main contractor arising from a fire at a building constructed under a PFI contract. The dispute involved questions as to the scope of cover under a PL policy. Following a hearing in 2020 the arbitrator dismissed the insured’s claim.I recently acted for an Annual Policy insurer in relation to a multi million£ CAR coverage dispute arising from the failure of a paint system on an energy infrastructure project. The case involved complex issues regarding the construction of the Annual Policy and the employer-arranged Project Policy; and alleged late notification under both policies. The claim was successful resolved pre-action with ADR.I acted for a principal contractor on a high value construction dispute arising from allegedly defective piling works at a major supermarket’s regional distribution centre. The dispute was successfully resolved at a multi-party mediation before commencement of proceedings.
