Representative matters include:•Remediation Sites – represented energy company at various remediation sites, drafted agreements and reviewed submissions to EPA. Prepared successful brief before the California Water Resources Control Board to uphold approval of client’s remediation project. •Outside General Counsel Services – Advised client on a variety of business and legal decisions. Drafted and negotiated agreements with government entities and private parties, including consent agreements, access and easement agreements, remediation trust agreements, and consultant master service agreements. Prepared comprehensive updates to the board of directors concerning the status of remediation sites. •NEPA Litigation – represented energy company in a successful defense against NEPA and Clean Air Act challenges to federal permits to build electricity transmission lines crossing the U.S. border. Drafted successful motions to intervene and for summary judgment. Worked directly with client expert to draft declaration cited in the Court’s opinion as providing the “clearest explanation” of technical terms. •Clean Water Act Enforcement Action – Worked with scientific experts on rebuttal to Regional Water Quality Control Board report seeking to impose sediment cleanup liability. Appeared before the State Water Resources Control Board to recommend revisions to proposed statewide sediment quality objectives, and prepared experts for testimony before the Board regarding same. •Land Use Litigation – successful opposition of petitions to set aside City approvals for a commercial and residential development .
