Assisting clients with environmental, safety and health compliance and administrative matters.Representation of East Chicago Waterway Management District:Since 2008, Ellen Gregory has served as environmental counsel to the East Chicago Waterway Management District, a governmental body established to promote the environmentally-friendly redevelopment along the waterways within the City of East Chicago, Indiana. The Indiana Harbor and Ship Canal has historically been the home to large industrial facilities which, over the years, have contributed to contamination of sediments on the bottom of the Harbor and Canal. Ms. Gregory represents the District in all of its environmental matters. This includes handling negotiations with the U.S. Department of Justice, U.S. Environmental Protection Agency, Indiana Department of Environmental Management, and U.S. Army Corps of Engineers to achieve the District’s goals of redeveloping the waterways of East Chicago. These negotiations include entering into Consent Decrees and various other agreements with these government agencies and a number of private companies with industrial operations in East Chicago. In the course of the representation, Ms. Gregory has coordinated with the US Army Corps of Engineers on behalf of the District, which serves as the local sponsor for the construction, operation and maintenance, and closure and post-closure of a disposal facility currently being constructed by the U.S. Army Corps of Engineers on property owned by the District. The nearly $180 Million disposal site receives contaminated sediments that are dredged from the Harbor and Canal to maintain the waterways for navigation purposes and to further the environmental remediation of contaminated areas of the Canal. Ms. Gregory has also coordinated with expert land value appraisers, accountants, and environmental consultants to accomplish the redevelopment goals of the District.

I help business clients and individuals with business formation, business disputes, contract negotiation, and landlord tenant matters. In early 2020, I developed a niche representing residential and commercial landlords and tenants, helping them navigate the legal ramifications of the COVID-19 pandemic emergency. I have also advised many clients with respect to the State just cause eviction and rent stabilization law (California Tenant Protection Act) that went into effect on January 1, 2020, along with local just cause and rent control ordinances.

Have handled matters relating to underground storage tank contamination and State trust fund recovery; environmental insurance coverage; brownfields redevelopment; asbestos; vapor intrustion; dry-cleaners and other solvent contamination; wetlands compliance.Shiel Sexton Brownfields Redevelopment:Ms. Gregory has represented Shiel Sexton, an Indianapolis-based construction and redevelopment company, in purchasing, remediating, and remodeling a former industrial building in the City's downtown area for use as a commercial building. Ms. Gregory's representation of Shiel Sexton in this matter included negotiations with the seller of the building and the former owner and operator of a lens manufacturing operation, Textron Inc., as well as site access agreements with adjoining property owners. She also brought claims and recovered against commercial liability insurers who had covered prior owners of the site. Because of solvent groundwater and soil contamination, abandoned underground storage tanks, potential vapor intrusion issues, and indoor contamination, the site needed substantial remediation prior to use as occupied office space. Ms. Gregory coordinated agreements with past owners, the Indiana Department of Environmental Management, environmental consultants, and future tenants of the refurbished building.UST Spill, IDEM Enforcement, and Tank Fund Recovery:A mechanical malfunction at an underground storage tank in Southern Indiana resulted in a release of product to the groundwater, which then made its way to a nearby stream. The Indiana Department of Environmental Management (IDEM) issued a Notice of Violation seeking penalties. The UST owner/operator also filed for reimbursement from the State Tank Fund, which IDEM initially denied. Ms. Gregory reached a settlement of the enforcement case and resolved the Tank Fund request.

While at Jones Day, Ms. Gregory served as outside counsel to an international tire and automobile service operation, handling all environmental compliance and enforcement issues for the company's retail operations nation-wide.

While at Seyfarth, Ms. Gregory represented a number of clients in Superfund and RCRA cases, handled insurance recovery cases, and was involved in numerous fatality cases.

Ms. Gregory represented a plant manager accused of criminal violations of California State environmental laws for allowing process waters with high levels of metals and other contaminants to enter the local wastewater treatment plant.
