I am an environmental attorney focused on helping complex industrial facilities comply with environmental regulation at reasonable cost while maintaining the greatest operational flexibility for future product and process innovation. I have assisted in over 200 PSD permits, a larger number of Title V permits and in air compliance activities for major facilities in iron and steel, mining, electricity generation, oil and gas, natural gas transmission, manufacturing and other sectors. I have also defended EPA national enforcement cases, litigated PSD matters in federal court, and assisted with compliance program development. I also have significant experience in state implementation plan (SIP) and federal implementation plan (FIP) development, reconsideration, and litigation, including regional haze, general implementation plan and source-specific implementation plans. I am also the lead author for NSR Law Blog, which provides an ongoing overview of developments in new source and modification permitting and a co-author of the Air & Waste Management Association's New Source Review Manual..WATER: I have assisted with numerous NPDES permits, helped develop group storm water permit application and participated in developing watershed based permitting programs; assisted in interstate litigation over water quality standards; and developed Clean Water Act compliance programs for complex facilities. I have worked with state groundwater protection programs.WASTE: I have assisted complex facilities with RCRA compliance matters, state solid waste plan and facility approvals and permitting, and have extensive experience with RCRA recycling determinations under the definition of Solid Waste.HAZARDOUS MATERIALS: I have worked extensively with EPCRA and TRI; DOT transportation security and hazardous materials regulations, and TSCA PCB control regulations.AUDITS. I helped develop and continue to lead a Fortune 500 company internal audit program that has resulted in significant internal improvement in environmental performance. We have successfully defended this program from efforts by the U.S. Department of Justice to access findings.TRAINING. I have helped develop internal corporate training programs to significantly enhance the ability to clients to handle and manage their own environmental affairs.
