I have helped establish and operate many wetland mitigation banks in and outside of Florida. My mitigation banking experience includes the following:• Obtaining governmental authorizations for mitigation banks.• Negotiating and drafting agreements between landowners and mitigation bank sponsors.• Negotiating and drafting credit sales agreements.• Resolving bid disputes for mitigation credit purchases.• Resolving mineral rights, easements, and other encumbrances and title issues.• Performing mitigation bank feasibility studies.• Defending mitigation banks against legal challenges.• Lobbying on legislation and administrative rules affecting mitigation banks.I also assist developers, utilities, agriculture, mining companies and others in obtaining permits to impact wetlands or defending against wetland related enforcement actions. This includes working with state agencies such as the Florida Department of Environmental Protection and Florida’s water management districts, as well as federal agencies such as the U.S. Army Corps of Engineers, EPA, and U.S. Fish and Wildlife Service.In water supply regulation, I assist water utilities, agriculture, electric utilities, mining companies, and manufacturers obtain water use or consumptive use permits. I also help plan for future water supply development and work on water management district water supply plans. I help navigate complex water supply regulations such as minimum flows and levels and water reservations. I have experience in the Underground Injection Control (UIC) program. This includes obtaining UIC permits, administrative orders, and water quality exemptions. I have worked on Class I disposal wells, Class V disposal wells, exploratory wells, aquifer recharge wells, and aquifer recharge and recovery (ASR) projects. I have successfully defended UIC permits against legal challenges.
