Assisted the firm with litigating patent, trademark, trade dress, and copyright matters as well as counseling clients about contract and licensing issues related to intellectual property.Representative Matters: ■ Lead associate on trial team that secured $2.5 million in damages for breach of contract from a Boston federal jury (court award totaled $3.2 million). Trial contributions included successful direct and cross-examinations of key fact witnesses. ■ Successfully defended MStar Semiconductor at the International Trade Commission (Inv. Nos. 741/749) against claims of patent infringement brought by Thomson Licensing against LCD products containing MStar scaler chips. Thomson sought to exclude from importation a large percentage of the LCD products sold in the United States. In its opinion affirming the trial court’s finding of non-infringement, the Commission cited my arguments at trial as a basis for also awarding MStar a new trial on invalidity.■ Secured dismissal of patent infringement suit brought by CopyTele, Inc. against client E Ink (the world’s largest supplier of electronic paper displays) based on lack of standing. ■ Drafted briefing that secured the rejection of a patent’s claims (related to a mechanical device) during an inter partes reexamination. After this rejection, the patentee/plaintiff in a co-pending litigation moved the Court to dismiss its own patent infringement claims from the litigation. ■ Lead associate on trial team that won client a judicial dissolution of an LLC in the Delaware Court of Chancery, restored control over client’s right to use intellectual property, and defeated the opposing parties’ counterclaims for breach of contract, breach of the implied covenant of good faith and fair dealing, and breach of fiduciary duty.■ Counseled startup companies and inventors regarding intellectual property development strategies.

Conducted research and wrote memoranda on a broad range of legal issues including domain name dispute resolution, medical ethics, employment law, evidence, attorney-client privilege, products liability, fiduciary duty, easements, civil procedure, malpractice, fraud, unfair business practices, civil rights, negligence, and insurance. Drafted a deposition outline, attended court hearings, and a mediation.

Responsibilities included conducting research, preparing bench memoranda, and drafting judicial opinions on a variety of civil and criminal issues. Assisted in the drafting of various opinions, including a Medicare tax issue of first impression. Provided editorial assistance in the selection of important First Circuit cases and drafted case summaries for MCLE publication entitled Recent Developments in Federal Law 2006.
