I am a first chair patent and trademark litigator, and a shareholder in the New York office of Carlton Fields. I have been named one of LAW360's Trial Aces and maintain a diverse practice in intellectual property law, with patent litigation as my core practice focus. I advise clients and litigate patent, trademark, trade dress, copyright, and false advertising cases in the U.S. and internationally. My practice also includes worldwide acquisition, enforcement, and licensing of intellectual property. My notable patent litigation matters range from the largest ITC case of its time to an historic patent case in which I obtained the first-ever preliminary injunction on a design patent for Oscar Mayer’s Lunchables product. I also represented Pepperidge Farm in a landmark case, obtaining preliminary injunction based on dilution of its rights to the shape of its Goldfish cracker. I have represented Kraft in a false advertising case with respect to the company’s Jell-O gelatin product. In a landmark Second Circuit case under the Digital Millennium Copyright Act, I represented Joe Simon, the co-author of the famous Captain America, against Marvel Comics, giving Mr. Simon rights to recover his copyright from Marvel. The World Trademark Review 2014 notes that “Ethan Horwitz is ‘a robust and intelligent litigator’ who is regularly selected to act on critical conflicts.” I am the author and editor of four prominent treatises on IP law published by LexisNexis/Matthew Bender & Co: Horwitz on Patent Litigation (3 volumes), Intellectual Property Counseling and Litigation (7 volumes), Horwitz on World Trademark Law (5 volumes), and Patent Office Rules and Practice (13 volumes).Attorney Advertising
