I am an Accredited Mediator in both Inter Personal (Accredited 2014) and Commercial Mediation (Accredited 2016). In 2017 I completed a Post Graduate Diploma in International Comparative Commercial Arbitration from QMUL, achieving a Merit. I provide specialist employment advice (focused on resolution and agreement) to Employers and employees alike as well as private mediations and mediation services to the Gibraltar Employment Tribunal. I also provide coaching and consultancy to senior managers on workplace ethics and lecture on conflict resolution and mediation to HR and managers. In addition, with over 18 years experience of Commercial Litigation in both the UK and Gibraltar I have extensive experience of the benefits of utilising ADR methodology in all areas of conflict. It has become my passion to bring ADR to the forefront of litigation practices with a view to making the process of resolving conflicts less costly, less stressful and less acrimonious for all involved. ADR enables the parties to retain their autonomy over the process and are able to drive the conflict towards a results focused, cost effective, efficient and mutually acceptable agreement. I use my passion for resolution to help effective and ultimately successful negotiations and settlement discussion in commercial litigation.

MediatorFiona Young Mediation Sep 2016 - PresentGibraltarI have extensive experience of working with parties involved in disputes towards positive resolution. Conflict can be disruptive to lives, businesses and relationships. Mediation is an excellent way of focusing the parties minds on positive resolution with a view to moving forwards and away from the initial cause of conflict. Litigation is costly and time consuming and can have lasting emotional impacts on parties when they do not achieve the result they intended. Mediation takes parties away from the litigation process, invites positive communication and joint problem solving, empowering the parties to solve the issue themselves. In addition participants in mediation learn new skills which they can utilise in future situations to prevent reoccurrence.Where mediation is not able to assist the parties there are alternatives to the formal court process, such as Arbitration. In a commercial setting, particularly in international disputes, an established and agreed arbitration process can assist the parties in steering a steady course through conflict. Experience shows that well drafted Arbitration clauses in contracts can be a useful preventative measure to avoiding conflict at an early stage. I am able to advise parties on suitable arbitration clauses in commercial contracts, particularly those with an international reach as well as advise parties who are embarking or considering commencing an Arbitration process.
