For more than 24 years, Mr. Kessler has managed a broad array of distressed asset workout, turnaround and crisis management assignments. He joined the Advisory Division of Marcum, LLP as a Manager in 2001 and is now a Senior Manager specializing in three practice areas: (i) bankruptcy and insolvency; (ii) fiduciary services; and (iii) litigation support.Bankruptcy and insolvency duties entail the take down and assessment of operating businesses and real estate. Businesses are analyzed as a going concern. If such determination is made, the business will be positioned for a plan of reorganization which may include continuation, merger or outright sale. During those instances where a business is not a viable going concern, the collective assets are marshaled and liquidated at the highest attainable price.Participates in receivership or similar fiduciary assignments as delegated by and during Court proceedings. Duties are similar to those bankruptcy trustee support assignments detailed above. The primary objective being to preserve the business placed in the custody of the receiver until terminated through judicial proceeding.Also skilled in the quantification of economic damages relating to a variety of matters in litigation including business interruption, delays in construction, breach of contract, shareholder disputes, copyright infringement and more. Expert reports are prepared in both state and Federal court forums and offered in support of expert witness deposition and trial testimony.

Miami/Fort Lauderdale Area

Assistant Vice President and Supervisor of Asset Management and Evaluation for the Southeastern Regional United States portfolio comprising 800 loan assets with an aggregate book balance exceeding $4.7 billion. Duties included supervision of the collateral review process, property condition evaluation and risk analysis for over 45 institutional and non-institutional investors including First Union Capital Markets, Freddie Mac, ING, JP Morgan, GMAC, GE Capital Corp., and others. Duties further encompassed problem loan workout, loan underwriting and due diligence, processing special requests including loan assumptions, extensions and modifications, releases, lease review and evaluation, construction/demolition, partial releases, SNDAs, etc.

Fort Lauderdale/Boca Raton

Beginning in 1991, served as asset manager responsible for the management and disposition of REO and performing/non-performing loan assets collateralized by commercial real estate, with aggregate book values exceeding $500 million. Duties included (i) business plan development; (ii) due diligence; (iii) liaison between RTC and defaulted borrowers; (iv) property inspection and evaluation; (v) budget preparation; (vi) sale case preparation and presentation to Executive Review Committee (voting member Executive Review Committee 1995-1998); (vii) organization and conduct of sealed bid initiatives; (viii) preparation of purchase and sale agreements; (ix) preparation of transactional documents for legal review and orchestrated closings. Appointed Environmental Program Director, tasked with the environmental oversight of 1,500 federally owned assets with an aggregate book value of 1.5 billion. Duties included review of all Phase I Environmental Site Assessment, project management of contamination assessments and remediation, with contracted expenditures exceeding $10 million. During this same period, duties also encompassed those of property manager for approximately one million square feet of distressed commercial real estate and environment. From 1996–1998, duties further included due diligence, loan underwriting and asset management assignments for various Wall Street opportunity funds.
